Job doesnt exist anymore

Hi,

I was calle din the office at my job last Wednesday to be told that due to the department being restructured, as from the 7th March my position no longer exists.

I have been put forward for the only two vacancies in the company (which i have very little chance of getting as i have NO experience in these areas) and if i'm not successful, Friday will be my last day.

I have only been with the company since last July so realise I am not owed any redundancy money but what am i entitled to?
I have to give one months notice if i leave so i'm guessing that i should get that from them? I've also clocked up 4 days holiday that i havent taken and will have worked 2 weeks since my last payday. Will i get paid for that?

If anyone could help i'd really appreciate it. I am due to complete on the flat i'm buying in 3 weeks and am also waiting on results as it would seem i have MS (which could affect me working in the future) so this couldnt have come at a worse time really.

    Sorry to hear your bad news. I think if it were me I would be on to ACAS tomorrow http://www.acas.org.uk/ for free advice and guidance, they really are helpful.

    Thanks.I'll have a look at that now and call them tomorrow. I do feel its slightly personal as well. I was given a written warning just before Christmas and put on a performance improvement plan, which i was taken off in February as I'd clearly shown I could do my job and do it well.
    Also I've had to have 5 days off sick as 2 weeks ago i had a lumbar puncture and endless other tests which resulted in me being quite ill. They know about this as i am going through the work's BUPA scheme.

    Also, will i be entitle to stay with Bupa through my notice period? Too much to cope with at the moment.

    During your notice period (provided they give you your proper notice), all the benefits of your employment continue. So you will continue with BUPA membership for that period of time.

    Check your written particulars regarding your notice period. It would be very unlikely that they would require a month's notice from you and not be required to give you the same notice - but do check.

    If they don't give you proper notice (that is pay you for the notice period from the time they formally dismiss you), then you can claim for compensation equivalent to the amount due. Again you need to look at your written particulars to see if there is anything written about this - whether they retain the right to pay in lieu of notice. If they haven't done that and they do not give you proper notice, the compensation may not be taxed because it is not a contractual payment under your contract of employment.

    You are also due to be paid for any holiday accrued but not taken. They could, however, say that you have to take this holiday during your notice period and therefore holiday and notice would run concurrently and you would not be paid extra.

    I have one more question, if i am made redundant on friday, am i allowed to work immediately somewhere else (if possible)? Or do i have to wait until the month is up?

    I don't see why you can't start work immediatly.. go for it.

    Have you considered registering with a temping agency? I did last week and start work on Monday. Also if you MS becomes a problem you could adjust your hours around it maybe?

    Yes i canlled a couple of agencies on thursday and friday. One's i have a good relationship with as i used the m to recruit staff in my last job so hopefully i wont be out of work for too long.
    With regards to me possible having MS i just worry that is i have to mention it on an application form it might put people off. :(
    It will only be mild anyway as i only have a few symptoms at hte moment (5 people in my family have MS so i know the varying severities). Will know for definite on Tuesday about that and wednesdya or thursday about my job.

    Had ameeting with HR today. I have an interview tomorrow morning and one on Friday for the vacancies in the company.
    I asked what happens on Monday as i wont know about either job by then and my curent role wont exist and i've been told "oh no, still come in, we'll find you something to do!" :confused::confused:

    I am so confused. I was diagnosed with MS yesterday and am not sure whether to tell them or not. Do i have to?

    Personally I would hold off telling them until you know a bit more about what is going on workwise - it sounds like they may have plans for you if they've told you to come in on Monday anyway.

    I don't really have any advice for you, but i wanted to offer my support.

    Its a shame most companies treat their staff like this now- no job is safe anymore. My mums husband has been made reduntant by his company twice now so that the staff have to re-apply for the same job with a different title so that they take a wage decrease! It just wrong.
