Sorry to be the bearer of bad news but unless you tell them at the start of the call that you are recording the call they would not be admissable as evidence as it is basically entrapment...

Thank you all for your contributionsI have talked to Payplan and they believe it is worth me trying this before going on a DMP, I have equity in my house which at 60 years of age I am not ready to relinquish and which I could not release by re-mortgage - my existing mortgage is interest only anyway. Also being self-employed I do not have a guaranteed monthly income, just depends how the jobs fall and the customers pay.I am planning to offer about 37% of the debt with apyment within the next 30 days. This is probably more than they would get on most plansFingers crossed - we'll see how it goes

    Hi IA,

Oh I do, It scares the crap out of them. It also works well if you can't be dealing with them that day for whatever reason. I always ask their name and could they spell it for me as I'm recording this conversation and generally they go quiet then put the phone down. If they stay on the line I generally ask "is this call being recorded?" Some say no it's not to which the reply is "that's ok, it is at my end" or if they say yes it's that's ok we can coroborate it also as it is at my end also or words like that.

One started out at 10% discount on the phone there and then but I sent a letter in and offered 20% they replied that it wasn't enough then it got to a bartering point over a few months. One creditor took 39.85% of a £8671.19 p debt ( they wouldn't take any lower than 40% so I always like a challenge and played one creditor off against the other like you do with insurance) and the other took 60% of a £6,243.94 debt. That one was a hard faced company that wouldn't budge 1 inch. Both were paid over the phone with a debit card and I've never had any comeback like oldernotwiser suggests but then virtually all my creditors already have my account details as they have set up a DD for the DMP.

I wasn't planning on telling them that I had the money but that a relative was willing to help and that the money would only be available under these circumstances.

Take advice on that. Sounds like fraud to me - obtaining a pecuniary advantage by deception.

The debt charities advise you to do this. If you didn't then the creditos would expect you to pay the lump sum and then carry on with instalments.

So you lie, then you get an advantage through lying?

Sounds like obtaining a pecuniary advantage by deception, to me.

It is an inheritance. I was specifically told to use it to my advantage and not to fritter it away which is exactly what I plan to do. The fact that the relative is deceased is not relevant. So i am not really telling a lie
