Getting a Delivery Refund

I bought quite a bulky item from an Ebay trader, paid £20 for P&P but when it turned up it was missing parts and looked nothing like the picture (colour of wood was much darker than picture). As such, I send the item back (hand delivered) but he only refunds me the cost less P&P.

Should he refund me the entire amount as I am now £20 down?

    The seller should refund the entire initial payment including post and packing. They do not have to refund the costs of return postage.

    Has the seller stated any refund policy? I can understand the frustration at being £20 out of pocket but I think that usually just the purchase price is refunded. If you hand delivered it back, could you not have picked it up in the first place to save you postage costs in case of a situation like this?

    They would not allow collection.
  • If the item is not as described ebay require the Seller to refund in full including the p&p

    It's paypal rules, so if a chargeback is made via them then the full initial costs are refunded.

    However, on re reading the OP there is a problem here if the seller turns out to be less than honest. To obtain a paypal refund the goods must be returned to the seller and paypal will ask to see tracking to prove this has bene done. Obviously the seller can tell paypal that goods have arrived and that refund will be given, but as the goods were returned by hand a difficult seller might just refuse to confirm receipt, and no refund at all will be given.

    The OP now has no goods and no refund..which is not a good situation.

    Soolin, I did aim off for this and got them to sign a form that I created for the fact that I returned the item. It looks as though they are coming round after I sent an email saying that this was obviously just an oversight for them to miss off the delivery amount in the refund!!

    Can anyone direct me to the terms and conditions on Ebay stating what I am entitled to?

    The seller is saying that under distance trading rules I am not entitled to the P&P to be refunded using the seven day rule.

    Your form might help if you need to goto the police later, but I doubt it will be of any use if the seller informs Paypal you have not returned the goods, they will need to see online proof of delivery or you will lose your claim.

    You won't find this anywhere on ebay, see earlier responses. It is just paypal that will require the seller to refund the whole of the original payment if you win a paypal claim. However..having to go to a paypal chargeback (and don't forget you only have 45 days to do so) is why i was so worried that you don't have paypal approved tracking to show item has been returned.

    AS for whether there is any basis in law that requires the original postage returned, I don't know..I'll leave that to others to link to.
