i purchased a nintendo DS on the 27th November 2007. was playing on it the other day when suddenly the top screen made a pop noise and stopped working. it has a black blob and two yellow lines running down it. i took it back to gamestation who said it must have thrown it or hit it for that to happen. i did neither. they told me to get in contact with nintendo who then told me to get in contact with gamestation. Gamestation says that because it was my fault it isnt covered by the warrenty. i explained i hadnt done anything but the refused to believe me. I dont know what to do. help!!!!!

I would speak to Consumer Direct or Trading Standards and get their advice. Consumer Direct are usually very helpful. Good luck....:)0

I dont know if your age is relevant here,but when one of my sons tried to take something back they refused him a cash refund he was entitled to.When my other half went in,they had to admit they had been less than truthful.,and the Manager claimed not to know much about refunds as he was new- utter c@rp!-
Let them send it back and prove the damage was done by you-presumably they cant.0 -
Under the "Sale of Goods Act 1979", the shop can be responsible for free repairs for up to 6 years, depending on what the item is, and what a reasonable shelf life is classified as. I would expect my DS to last for at least 3 years with reasonable play!
Take it back to Gamestation, and tell them it's faulty and you want a replacement (stating the Sale of Goods Act), and if they refuse, then tell them you'll be taking it up with their headquarters and trading standards.

Give them a certain amount of days to respond, then if you get no response, contact trading standards.
The staff in gamestation aren't the brightest bunch, so they're probably clueless about consumer rights. Our local Gamestation appears to be run by spotty adolescents!Should've = Should HAVE (not 'of')

if all else fails you could try claiming on your / parents home insurance cover.0

It really is up to Gamestation. If a fault develops in the first 6 months, it's legally seen as being faulty at the time of sale. They have to sort it out. Up to the first six months, they have to prove it wasn't faulty, which they simply can't do. After six months, the onus of proof is on you, AFAIK.0
