    1) yes, providing you gave the LL opportunity to rectify the problem and yoy folowed the correct steps

    2) no point going to the papers yet, best waiting till after any court case

    not sure how much it affect things though with you moving out, but hopefully you will still have a case as it was so bad you were forced to move out.

    the section dealing with claiming your rent back is called "rent abatement"

    HAVE FINALLY HAD DEPOSIT RETURNED!,
    HAD AN OUTSTANDING WATER BILL PAYABLE PERSONALLY TO LANDLORD NOT THE WATER COMPANY AND DEDUCTED £37.00 FROM IT WHICH IS HOW MUCH IT COST TO GET A PEST CONTROL TO REMOVE 9 DEAD RATS COVERED IN MAGGOTS WHICH WERE COMING THROUGH THE CEILING...

    My letter to Landlord :
    Please find enclosed a copy of the pest control bill and water bill.

    We felt the need to deduct the £37.00p to compensate us in the inconvenience and cost of the pest bill when we had the problems with the maggots coming through the ceiling in November 2007, in which we feel as though it was your responsibility to deal with.

    Therefore please find enclosed a cheque for £31.29p


    Their reply
    I recieved your letter and cheque this morning

    Please forward either the balance of the amount owing or the details of your legal representation

    I can see now why you wanted the deposit back so quickly and am dissappointed after our discussion that you now wish to do this the hard way - however as a matter of principle I inten to pursue this outstanding amount

    Not only was pest control an obligation under your lease I managed the situation at no charge for quite some time. I also expedited the return of your bond prior to you finalising your bills as I understood you needed the money for your next move

    In addition who do you think gave you such a good reference with new landlord which has allowed you to move into the flat you are in?

    My intentions were good and now you have me out to be a fool for trusting you

    My lawyers details are XXXXXXXXXX

    OFF LATER THIS AFTERNOON TO CITZENS ADVICE TO GET BOOK SOME LEGAL ADVICE!!

    My advice is that it was really stupid of you to do this for £37.

    Hi what a nightmare the whole thing has been for you.

    Reading through it all i have to agree as petty as the £37 may be to others i would have prob done the same thing out of principal! What about rent back though due to the time you did live their? it has gone on for so long and the constant trying to get round it by the landlord seems ridiculas, fight your ground and stick with it.

    can only say the citizens advice really as they are pretty good..

    Do you know what baffles me the most is how landlords etc let their propertys suffer? we had one who let the house just go, we moved too as he was never going to do anything! You would think it would be in their interests eah! obviously not..
