  • ASN all i got from Lloyds was a signed copy of my last statement and a copy of terms and agreements. I too am not sure where to go from here. They have now stopped interest on my CC after telling me they refuse to accept my DMP and will not stop interest so not sure if i want to rock the boat by sending more letters but then I am not sure what to put in a letter if i do send one (confused) It is def not a CCA they sent but they did cash my chq.

    If your agreement dates back to 2002 then they must supply a true copy with the sig

    They are trying to cloud the issue with either the new version of the legislation or are hoping to rely on the Rankin case argument :rolleyes: (both non starters if you play it properly)

    dmd , good news ! They have admitted they have no CCA and can not provide a deed of Assignment , so basically can not prove the debt .Send them the bog off letter . Keep the letter safe this will be needed if in the VERY unlikely event of a summons . Remember if there case was strong they would never offer a low settlement figure .

  • well i have received my statements from dlc...they have 'put the account on hold and all further action has been suspended in anticipation of receiving the documents required'

    the 12+2 are up on Monday....i'll let you know if i hear anything more!!
  • Hi i haven't posted on this forum for ages but have been following this thread and following its advice.

    I have sent request to

    Westcot
    Egg
    Cabot
    Compucredit

    I did Cabot first and they came back with the usual bullsh*t about getting the cca from the original lender blah blah blah but they have put the account on hold I then sent them 30 day letter and haven't heard another word from them (2 months now)

    I have heard nothing from egg or compucredit (6 weeks)

    However yesterday I got a letter from CCCS (who I am on DMP - at least I was i have stopped paing it) enclosing a letter from Wescott saying

    "Further to your recent correspondence regarding the above account.

    Following you recent requestion for a copy of the signed agreement, we have closed the account and no more correspondence will be sent to you regarding this matter.

    Trusting the above clarifies the situation.:rotfl:

    The debt was originally MBNA and was for £12,000. The CCA for this debt as for my other ones was signed about 12 years ago and I do believe this is significant. Egg for example have been sold twice since I signed my CCA and I don't expect them to be able to produce it. Likewise Cabot who bought my debt from Morgan Stanley won't be able to produce it, they keep saying they are asking their client but Cabot buy debt they don't act as agents and Morgan Stanley have sold it they don't care any more.

    Hope this encourages people to keep asking for their CCA's.

    And by the way just in case anyone is wondering I couldn't care less about not paying my debts back. I have over the past 12 years paid about 3 times what I owed in interest. I have been diagnosed with cancer twice in the last 3 years and all I am interested in is getting myself back on my feet.

    But at least with a low settlement then the debts gone and they stop chasing you.

    just to clarify though, they didnt take the offer of £500 proposed to them by the trading standards guy. Trading standards guy offered on my behalf a payment of 500 if the account goes on hold at 500 for the next 12 months since im a full time mum and my partner has just been made redundant and circumstances prevent us from paying much towards anything at the moment. I would have loved them to take 500 just to get off my back but the only way they would was if I paid a lump sum 500 up front now and that would be it but if I had that to pay then I wouldnt be in debt if I could throw that sort of money to any one of my debts at one time. Im a bit stumped as to what road to take with aktiv kapital at the moment, i know i aint gona pay up front but at the same time i am not paying what they are asking cos i know the previous creditor JD williams have put alot of interest and charges on the balance of what i did owe. I will be willing to pay for the goods I ordered just not the unfair charges. I have been a very loyal customer of them till my partner first lost employment back in 2005 and still kept up with payments till i missed a few then things roller coasted. I guess i dont have to go into much detail you are all in similar type situations. I just cant believe the balls this guy had saying the credit ref file was enough evidence to take me to court and when i stated it wasnt, he was like "oh is that right, do you really think that is the case, we will see" and so on. I just want to prove this idiot wrong by swatting up on the consumer law and being in the know when it comes to my rights. Im off back to school now to get my head in some sites/books to help me on my way as its sometimes confusing when you dont know the full story. Thanks guys for your help though, like ive said before if it wasnt for people going through similar stuff on here id be depressed as hell wondering how to pay all of my creditors. love to ya all xx
