If the debt was a credit card and you sent the £1 payment for the procaessing cost then they do need to send the cca. After 12+2 working days, you can send this letter to them.

fermi - but can you confirm that the 6 year limit does not apply to the cca request, i.e. irrespective of how old the account is the cca should be produced on request?

There is no limit. If they have operated a company policy of only keeping agreements/documentation for 6 years, then that is their own stupid fault.:p

after my second letter re-wescot not got CCA and cannot therefor send me one!.....had reply saying no CCA, passed account back to client, all data held on me is removed - they have done nothing or made no notes on my credit rating etc - say they have done nothing so my credit rating is as it was...
they say if i want a CCA i need to request from their client...
what do i do now? sit and wait ? or another letter to wescot or their 'client' ?
Fermi and Rog any ideas at all please? know you two and a few others are fab on these areas!

Okay, I think I'm further on than most of you with regards my CCA (its actually my husband's CCA for those of you who don't know me!).

I went to court today re possession order on my car and had to return in the afternoon to deliver Allocation Questionnaire for OH's CCA (funnily they were both due on the same day in the same court!). After having the straightforward possession order and seeing first hand how a hearing works I really feel I've bitten off more than I can chew with this CCA but I've got this far so won't be stopping now. Basically we just wait to hear from the court about what the next move is but hopefully I will be able to draft a new defence.

I've been getting loads of help from CAG - they are wonderful!

I'll update you when I have something to update! Good luck to all of you.

Right, I've had no response to the third letter. Am I right in thinking that I now report them to the FOS and the nearest trading standards to their offices? Do I just state that they've refused to respond to my CCA request and give the dates of my letters?
Unless I say otherwise 'you' means the general you not you specifically.

just about to type the 30 day letter to Mackenzie Hall/Cabot as their time is up and no documentation to prove OH owes them the money. Still lost in the archives I believe. I'll let you know whathappens next......

Yes - you need to do this, in order to register the 'default'.

As ever - keep copies of ALL letters.

re the trading standards - is it the TS nearest their office, or the TS where you live? Seen both mentioned and wondered.
