    As gargrave says we would need to actually see it for definiate confirmation but...

    I also has CCA request to 1st Cretins a few months back (also for BC) and I got back a badly copied application form. They followed this up with a letter asking for proof that that was my signature on the form and a few other questions (I totally ignored this letter). 12+2 later i sent the 12+2 letter and guess what - I have heard nothing from them since.

    I'm not saying my case is the same as yours (but does sound familar).. its just to give you some faith that what you are doing isn't as scarey as appears. The majority of DCA's (in my experience) do not have the correct paperwork and they know it. They prey on the weak and vunerable.

    I sent my first letter to request a CCA to moorcroft in July and enclosed a £1 fee. I then got a letter back from moorcroft saying that they will duly ask for my cca from citicards and that they have put my account on hold, till august. After the 12+2 days had elasped and I heard nothing I sent the second letter to moorcroft this was sent early in august. I sent both letter recorded delivery.
    At the start of august I got another letter from moorcroft which said I have to contact citi to obtain the CCA that I requested from moorcroft. They put my account on hold again with moorcroft and they asked me to phone them to discuss the account ( which I didnt do)
    I understand that now they are in default as they have not suppiled me with a cca that I requested from them.
    I got two letters from moorcroft last week to say that again I should contact citi to get a CCa from them and the other letter said that if moorcroft take me to court, it shows how much I will be paying ontop of the debt.

    So I dont know what to do now.


    I know that I can report moorcroft for not supplying me with a cca to trading standards.

    Can I write a letter to moorcroft to see if they have a notice of assignment or if they are working on behalf of citi?

    Hello catwoman,

    I am in a similar situation. My post 3690 shows that in your case Moorcrap can't take you to court as you have no complete notice of assignment saying that Citi have passed all the rights and responsibilities on to them.

    What I have done is decided to apply for the CCA from the OC as the DCA I'm dealing with have suggested.

    I believe it should be the DCA who need to chase this, but nonetheless, I've decided to do it directly. As I have done this, I am ignoring the DCA completely.

    Should a CCA come thru (which I doubt), I assume the DCA will take over again....

    Just a quick update. This morning I received what appears to be my CCA from Next duly bearing my signature. The remainder is however illegible. I have now sent the appropriate letter as "borrowed" from CAG.

    Lowell Financial (for Shop Direct) have sent a letter saying my CCA is being retrieved from the archives, and once they retrieve this they will commence legal proceedings to retrieve the balance in full plus court costs. Not sure what to write back given that I have now sent 4 requests for payment details to commence payments - considering raising the case with OFT and FO - but not sure if I have a leg to stand on?

  • I have asked for a valid CCA for my AMEX debt well over 7/8 months ago now. Connaught who I was paying replied quickly stating that they did not have one and would be passed back to original lender.

    I then have received a demand from 1st Credit for this debt. I sent them a letter asking for the CCA but had not repsonse. I have since got letters from Scotcall - again I requested the CCA then it was passed to Mackensie Hall - again I asked for the CCA with no reply.

    Today I have received a letter from Meritforce stating that they are going to be sending an authorised collector to my house within 10 days!!!

    I have spoken to them on the phone and advised that I have not received a valid copy of a CCA agreement and that the account cannot be passed on whilst in dispute and his attitude was "well then report us!!!" I do not want someone to call at my door in regards to this debt and now out of principle I am refusing to pay until that valid CCA is in my hand!!

    Can anyone offer me any advice as to what I should do next!!

    Send a letter, say they do not have permission to vist your home if they do so you will call the police for them to be removed .

    A Consumer Credit Agreement must be clearly legible.

    Lowell are, simply, playing for time - something that the Law does not allow them to do. Have you informed them that they are 'In Default' by sending the 12+2 day letter?

    Standard Low-life tactic. They try until the last possible minute to get a payment. Once the 12+2 days are up they know they cannot ask you for money hence they are trying it on now. Just before ther 12+2 days are up you will probably get a "Get 60% off the balance if you pay now" letter.

    Same happened to me - strangely they could not find it in the "archives".

    My understanding is that if the DCA could not produce the CCA after the 12+2 then THEY are in default. The account cannot be passed onto anyone else. Therefore you should have not need to go back to the OC for a CCA. Moorcrap should have the CCA and they know that.

    I would not write to the OC at all - the account (unless Moorcrap are agents to the OC) has been passed to Moorcrap and it is their responsibility now.
  • hope someone can give me some advice here I have asked GM card for a copy of a cca there response to this so far has been to tell me that they now consider my account to be up to date as I have been making regular payments I have been begging them to lower there interest rates so that I can make a resonable dent in this for ages. today I recieve a letter telling me that they are unable to provide me with a photocopy of my original agreement but they have provided a copy of the executed agreement that does not cotain signatures they are also saying that as I have been making regular payments that it is resonable to conclude that I have acknowleged this debt therefore hfc bank holds me liable for the remaining debt.

    what if anything do I do now is it worth me offering full and final settlement or just stop paying them or do I continue as I have been doing in trying to chip away at it? this account was opened in 1994 any help would be appreciated
