What they will need if it is from before April 2007 is a signed Consumer Credit Agreement. I very much doubt that a car loan would have been given without the correct paperwork being signed . What has happened in many cases is that the paperwork has been lost . The original
company faced with a bad debt and no paperwork have then sold it on cheaply to a DCA . This DCA would need to produce a signed CCA in court to have a Judgement entered against you .0 -
Just thought I would post an update re the CCA's,Abbey have supplied me with my CCA,with photocopys of documents I sent them and also signatures-so it is all ok and will keep on paying them on DMP-I have sent them a letter thanking them for supplying it and too please hold of any defaults or any other actions until I get myself back on track and thanking them for there understanding,blah,blah..worth a try!
MBNA have still yet to supply me with CCA and havent sent any letters to me,I have been in touch with National Debtline via email and should get a responce in the next 5 days....will keep you all updated
Well,well well.....you dont get anything for ages,then 2 come at once! MBNA have sent me my CCA,all present and correct....oh well,looks like the same letter that I sent to Abbey will be going to them......0 -

I've got a question to everyone out there, and would really appreciate some feedback -
We've been on a dmp with payplan since 2005, finishing march 2011(hopefully, if all extra charges/interest are dropped). We owe about
We pay £672 a month, so don't have much left at the end of the month (London rent is sky high!), and are both in our 30's.
Has anyone put off having a family because of there situation - waiting until the dmp has finished?
This has been the hardest sacrifice for us, and our biggest regret with getting into debt.
If not, how does everyone cope with the added costs of a baby?

Me and my partner had the unexpected news she was pregnant,baby is due in 4 weeks,this really prompted us to enter a DMP and sort ourselves out.I had to take a pay cut due to down turn in business,and her maternity pay is diabolical,It is going to be really,really hard,but we will get through it and in a few years we will look at this time and think "jesus,how did we get throught it"? but it will all be good,as the saying goes,if you wait until you can afford children,u never will.Its funny,but you just seem to manage on a crap budget knowing that you soon will have a baby in your life.......
Sorry if this isn't much help,but thought I would let you know how things are for us0 -

Well assuming it is a pre-april 2007 agreement, if they have not supplied a copy of the agreement within the permitted timeframe under the CCA, the debt is in theory unenforceable. Bear in mind however it is only unenforceable until such a time as they supply a copy. If they subsequently come back with a copy of the agreement the debt "may" become enforceable again. I say "may" because it would depend on whether the supplied agreement has been executed correctly. If you read the walker vs southern pacific case the debt was deemed unenforceable due to the incorrect calculation of charges and interest.0 -
Still waiting for the managing director of a DCA to reply to my response to his "SIMPLE PLAN" . My plan is that they supply a copy of a signed consumer agreement !0

Well, Dispatches.
To those experienced members of the forum, the programme merely reminded us of the muppets we are dealing with. It was good to see the "Mark and Darren" characters did actually look like they sound on the phone!
For those who at the start of the fight, or are being intimidated, I hope the programme helped you. Pity they did not expand on the Section 78 request legislation, BUT, please if you are in trouble, DO follow the guidelines on this site and ask for advice.
I learnt something and that is to ask for whom they actually work (ie Marlin pretending to be a solicitor god help us!), so when you tape the conversation you can confirm the lies.
Hopefully, people will start taking action against these morons and their immature greedy and basically dishonest ways.0 -
hi everyone!!!
just a quick question, i have today recieved a letter from lowell portfolio 1 to say that after my cca request they are unable to locate it as the original creditor (littlewoods) cant find one, therefore they are closing the account and will not be contcting me agin in respect of the debt.
what im unsure of is, they have while the account has been in dispute placed a default on my credit files this was done recently am i entitled to request this is removed? and also where do i go noww do i just forget it until it gets bought by another dca, or is that not allowed?? bit confused on it all really so any info would be very much appreciated xself confessed 80's throwback:D
