She has however received a letter from a DCA informing her that they have taken over the debt from lloyds...It seems to me that Lloyds may have decided to pass this on since receiving the CCA request (abit of a coincident that they have decided to pass the debt on!!).. The DCA has also left a voice message requesting payment for the debt.

If Lloyds passed this 'debt' to a dca after they received your sister's cca request then they would, certainly, be in default.
No matter - once the 12+2 days have elapsed, send Lloyd's the '12+2' day letter, informing them that they are now in default. A copy of the letter can be found on post #6 of the following thread:

    http://forums.moneysavingexpert.com/showthread.html?t=963087

Then send the DCA a copy of the 'FORMAL NOTICE - ACCOUNT IN DISPUTE' that you will find on post#8 of the same thread.

Incidentally was the DCA called 'Secchiari, Clark and Mitchell'? If so, then these are 'in-house' solicitors/dcas for Lloyds - still naughty though. :naughty::naughty:

It shows how TSB opperate, and i can back that up with a paper trail that matches perfectly with that artical, i bet you can too cocker100

BLS has a postcode in oxford, a PO Box, but all mail gets re-directed to the collection centre in brighton, im assumeing MHA opperate in a simaler way.

In short BLS and MHA dont actually exist, they are trading names of Lloyds TSB bank PLC, and only exist on there CCL, they have no office, nor real postal address, and they claim they comply with the banking code, somehow i doubt deceptive measures like that comply
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

can someone tell me where I can get a copy of CCA to see whether I can test if the CCA that I have received from MBNA is enforceable?

also can anyone advice what letter I would need to send if the CCA is not enforceable.
    Thanks in advance.

To see the 'terms' that a cca must contain, in order to be enforceable, have a look at Weller711's post 'IS MY AGREEMENT ENFORCEABLE?' that I posted above (edit: and will re-post the link):

    http://forums.moneysavingexpert.com/showpost.html?p=7869437

I have suggested that post as she goes on to post an excellent 'template letter' that may, with a bit of 'editing', be applicable to your own case.

Good link, bat. :T Shame they didn't mention Secchiari, Clark and Mitchell as the 'next step' in their 'in-house' trail of oppression.

And to think that it is our taxes that are paying the lion's share of these 'thugs'.
