    I had this "conversation" with rog2 on here and he seemed to think that it is not a legal requirement to send the letter since the DCA know the rules of a CCA request. He said it was more of a "courtesy" letter. I would personally still send it. After all it doesnt hurt to remind them what they already know! :rotfl: And I do it just to get the papertrail incase it goes as far as court.

    It is, indeed, more of a 'courtesy', Baz, but still an extremely useful letter as not only does it show the creditor/dca that the 'alleged debtor' is aware of the protection that the Consumer Credit Act affords them, but it can, also, be a very useful piece of evidence, should Court proceedings ever ensue.

    So, on balance, it is better to send it - although a 'debtor' should not worry too much if he/she hasn't sent it, as it is the actual 'request' which is the most important.

    You wouldnt believe the amount of hours I have spent looking for the templates as and when I have needed them! So I finally got myself organised and saved that link in my favourites. I have called on it several times since! Worth doing yourself! :cool:

    This is a final responce letter to my complaint, yet they haven't sent me the CCA!:confused::confused::confused::confused::confused::confused::confused:

    Also, received a letter on Saturday asking why they hadn't received the DMP payment.

    Err, because I've removed you from it due to your non compliance as stated in my "Account in Dispute" letter.

    To further complicate matters, my credit file is still showing account settled, but now there is a default also registered! They cant do this whilst the account is in dispute though, can they?

    Any advice as to my next move or should I just leave it and see what happens next?

    Cocker, not sure what to advise with not knowing the full story. I assume you sent a CCA request and then a 12+2 letter? What happened after that? Did you make a formal complaint?

    Hiya Bazza, thanks for replying!

    I've sent 4 letters in total so far. The initial CCA request was sent on 1st October 2008. I then sent the 12+2 letter on 24th October 2008.

    Heard nothing in relation to the CCA request, but started getting demands for full payment from MHA collections, so sent another letter on 30th December 2008, stating that if they failed to comply they would be removed from my DMP.

    Got a reply back from their complaints dept and they said they would investigate within 4 weeks.:rolleyes:

    Still nothing else turned up , so I sent the formal "acount in dispute" letter on the 29th January 2009 and informed them that I had removed them from the DMP and no further payments would be made until they produced the CCA.

    Nothing else until this latest letter turned up. They make reference to my letter dated 29th January 2009, but it makes no sense.

    It is as if they are getting several account mixed up, as each letter makes no connection to the previous!!!!!:confused:

    I'm going to send then a SAR request to see what that brings up.

    I need some info on an old loan from them for a ppi reclaim and old statements for bank charges anyway, so I think it'll be money well spent.

    I've had 4 accounts with them over the years going back to 1996. Current account, 2 loans and a credit card, so I think they'll need a lot of paper!!!:D
