    I think TS would rather not be dealing with it , I do not really think they understand the CCA themselves . Probably snowed under with complaints . My prediction is that you will recieve a letter from Halifax saying the account has been closed and no further action will be taken .

    Lol Stapely I love you Soooooooo much xxxx MBNA have sent me a letter saying they dont have to provide me with a cca and are in fact LEGALLY entitled not to. Theyve also come up with another account number which was transferred to them in 1993 and advise me that a cca would have been sent to me with is card for me to sign and return.................................

    Guess What ??

    Unfortunately they cant find it have have no record of me registering the card with them. Good here isnt it ?? Ive sent them a letter saying they are still in default as they are threatening legal action, charging orders and recording defaults against me. This a a bit worrying what to do ??

    Can you afford to pay at a rate they want ? If not and they have still not come up with a CCA , you have not much to lose . It has been said before that they will threaten allsorts , and may even serve papers on you . This would be in the hope you do not defend , if you defend you may find they drop the action at the last minute . Also remember a JUDGE would not award any more than you can comfortably afford, if thats only £1 a month so be it .

    Also can you request a CCA for an overdraft which has been passed on to a debt recovery agency? If not is it worth doing this anyway?

    Overdrafts not covered , but make sure you claim unfair charges back .
  • recieved a cca back from mbna today just need to know if it is ok I have noticed in it that they have spelt my name wrong on it. I do intend to pay this debt but want to avoid the extra charges they are putting on it as these are overtaking what I am paying them so therefore the balance is increasing not reducing even though I am paying them what I can afford. could some one tell me what needs to be on the cca for a credit card agreement thanks in advance

  • Hiya i got the below letter today after i wrote to Moorcroft asking for my CCA.

    they received my recorded delivery letter with postal order for £11 on the 1st of Dec, i included £10 as i requested all the data they held for me too, but they have requested i send in some form of id before they can do this?? i didnt know this was right.

    This is the letter ive have got today i have no idea how to respond to this.

    I didnt know this thread was here i added a new one a few weeks ago.

  • It is there standard first reply to a CCA request, ignore it, it is designed to panic you by makeing you think you have started court action by your request.

    It will be followed by one or two standered threats followed by them saying they cant get the CCA, heres your pound back you need to request it from the OC, or they cant get one and the file is closed.

    If you get the first they will pop up again in a month or two with more threats, so that does need to be responded too, so if you get that letter just post again

    Referance the requested to send in some form of id they can ask, but its a bit late to worry if its you now, you could modify this to suit depending on what they are asking for

    Thank you for your letter dated xx/xx/2008 the contents of which are noted
    In your letter you make reference to requiring my signed authorisation /specimen signature** before you comply. I draw your attention to the fact that the Consumer Credit Act 1974 does not require that i supply you a copy of my signature before you comply with my S77/78** request.

    If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.

    However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?

    As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:

    7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

    My request for a true copy of my credit agreement under section 77/78** was made on xx/xx/2008 and the 12 working days for your compliance expire on xx/xx/2008. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity.

    I look forward to receiving the documentation requested

    I got a letter earlier in the week more or less saying the same thing they cant enforce it and its on hold until they get the CCA.

    I also asked for a copy of all the data they held on me, i included a £10 PO for that too, they said in the same letter i had to send them id to get that information.. so they playing funny now.. or is this standard??

    I have never been in this situation before, it is all very scary for me, ive basically took tips from this site lol.

    I have been tempted to just pay them.. but on principal i dont want to as not a debt i ran up.:mad:
