    It IS a good thing, bentalls, but you are right to be wary. They do not, now, have the legal right to pass your details to any other party, so if you are 'chased' by anyone else, for the same 'debt' you should report them to Trading Standards, or the ico.

    Thanks, Rog2, I shall be keeping an eye out to see if anything else crops up on this...Also keeping this letter in a nice safe place! Just out of curiousity, who are the ico?
    Is that a light I see at the end of the tunnel?;)

    One DCA acting for the OC sent me an elegible copy of a application form .They passed it to EOS who sent a pay or else letter . I informed both that the account was still indispute due to the elegible application form . I recieved a letter today from EOS , " should you be interested in paying a reduced amount to clear the account , blar blar blar".
    " in the near future , your debt will be taken from EOR by the lender . They will then choose one of the following further actions blar blar blar ," Doesn,t say " due to them not supplying a true signed copy of the CCA , They will have to write the account off ! "

    £323.22 in total, they took the £1 postal order I sent off for the CCA request, so it was showing as £322.22
    Is that a light I see at the end of the tunnel?;)

    Well its some thing ! It would not be worth chasing that amount in court . Thats why they have dropped it . But well done anyway .

    No, stapeley, they have dropped it because they could not legally enforce it.
    It is often the 'smaller' debts which dcas attempt to chase without the correct authorisation or paperwork - often because there is less chance that an 'alleged debtor' will query what looks like a 'small amount'. Multiply bentall's £323 by a couple of thousand similar debts that Moorcroft would be 'chasing' at any one time and it soon begins to look 'worthwhile'.

    Hi all,

    A few questions regarding CCA requests. I've a feeling they may have been answered before so if that's true then apologies and can you point me in the right direction.

    If the 12+2 time limit is exceeded and in the meantime you get a CCJ summons and non-receipt is your defence argument, how do you stand if it arrives before the hearing?

    If by the time you go to court and no cca has turned up, and by now its past 12+2 or even 12+2+30 and the claimant cannot produce either, does maintaining payments to OC or DCA go against you? Is the judge likely to accept that paying these has been an admission?
  • Aaargh!!
    I went down the CCA request route with Lowell because from the start of my debt troubles they have been truly horrible. To cut a long story short;
    I sent the request letter, they didn't respond.
    I sent the letter about them breaking the law, they send me a copy of my short application form (with a short statement about the CCA, NOT a true CCA).
    I sent them a letter telling them that what they sent me wasn't a CCA, and set out for them what one should look like (!).
    Today I receive a termination notice telling me that my account has been passed on to their legal department awaiting litigation.
    What do I do?!?!?!? I'm in a bit of a panic now.
