I stopped paying creditors this month, payment date was friday 22nd, to start saving br fees. Already had 5 calls today home and mobile. Question is do i tell them i'm planning br or ignore calls? The sick feeling in stomach is back already (used to have constant calls before i started paying £10pm) may take me a while to save fees so don't know how long i will be able cope with stress of calls again.
Also, i'm on IB, what are the chances of me being exempt from court fees? will i still need to save for this just in case? do they decide on a case by case basis with IB claimants as it's not on list of exemptions?
Any help would be great

To be honest, I wouldn't tell them no, they'll just increase the pressure on you to pay
This letter might be worth sending to stop the calls:
Date.

I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by FULL DATE, I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

It also might be worth putting in another letter along the lines of "I am aware I have not made this month's payment of £xx to yourselves. I am currently in the process of restructuring my finances and am taking advice from (insert debt charity here) and I will be in touch soon with a view to re-commencing payments as soon as I am able".
A big fat lie I know, but it should buy you some time.
I know how horrible it is to be constantly receiving these calls, they can really get to you. Would changing your telephone number(s) be an option? Drastic I know, but might be worth it.

Not booked a date yet as i don't know how long it's going to take to save the fees. Actually i need to phone my local cc to find out what their procedure is as regards booking. About to start online forms on insolv website, been putting this off as i'm scared to death!

I'm pretty much resigned to the fact that i'll get a BRO but the process of getting there is making me feel really ill.
Just to add, i do have call barring feature with bt in place (used this before they agreed to accept lower payments) but cannot block calls to mobile0 -

You won't be automatically exempt for being in receipt of IB, but you might find you're exempt under the household income rules.

Don't be scared, honestly, they're more time consuming than anything else and we'll all help you if you get stuck
It's really not worth making yourself ill over, I promise. You'll look back afterwards and wonder what all the upset was for. But I know it's easy for me to say that. I was in a terrible state before we went BR and my one and only regret is allowing myself to get like that and not believing all the lovely people on here who promised me it wouldn't be that bad

Now i don't know whether i'll be exempt..totally confused!:rolleyes: According to the info you posted scarlett, on my own i am but i live with my bf who earns more than the requirements. Are we classed as a couple?0

The constant calls drove me mad so I can empathise, in the end I told them I was going b/r and gave them a date it seemed to put them off a bit. Also I spoke to the manager of Capital 1 and complained about them hassling me. That seemed to do the trick as they backed down then and hardly ever called again.
Letter seems a great idea and is worded very well.

I don't know how much has been spent in all as i had wins as well, but it's going to look really bad for me. I never expected to still be in this situation two years down the line. I sent that letter first time around before payments started and they were ignored. Sometimes life doesn't work out how we expected it to and circumstances change that we have control of. Don't beat yourself up too much okay?
I don't know if you know, but it does actually ask on the form if you've lost any money due to gambling in the last 2 years and it does ask for a figure. So maybe see if you can work out roughly how much you've lost, I don't think you need worry about getting it exactly, but a rough estimate should be fine.You can't control everything in life....... your hair was put on your head to remind you of that
