Third party claim

Can anyone in the insurance industry advise please?
I recently had a shunt (hit in the side) which is generally considered to be the other drivers fault.:mad: I have filed my claim and my car is being repaired.
My insurers are having problems getting any response from the other side so far.
How long do we wait normally before starting the legal route? I have to pay my xs on completion and claim it back.
I understand that the FSA or Ombudsman may take an interest if their is poor admin of claims, etc..
Any suggestions/observations appreciated - thanks!

    Depends on how long you're prepared to put up with the waiting. Personally, I'd give it a few weeks and then get the legal thing going. I take it you paid for legal cover as well?
