US visa waiver entry

Hi all

I am going traveling round the US, and am eligible for entry for 90 days without a visa. However, I am leaving the us after a couple of weeks for Canada for a month. Does this month count towards these 90days, such as i will only be allowed back into the US for 45 more days before having to leave?

Also does anyone know how long I have to be out of the country to be allowed back in? I have tried looking on the embassy website but all it has is a number for a £1.20 per minute helpline (trying to avoid using that, what with being a good money saver:D)

    The time in Canada counts towards the 90 days - so yes, you will only be readmitted for 45 days if that's what the calculations come out as.

    There is no set period for being out of the country before being allowed back in. It's entirely at the discrimination of the US immigration official. What he'll be looking for is that your second entry (and departure) are within 90 days of the original - or that it's an entirely fresh trip, not a continuation of the original.

    Going to Canada doesn't count as leaving the US BTW - however long you stay there. You have to leave North America entirely.

    Are you sure about that? I just handed back my visa waiver form at the Canadian border and that was me officially out of the US.

    My understanding is the same as dzug's. I'm sure it says as much somewhere on the Embassy's website.

    If you had a ticket home out of Canada within the 90 days then it was OK, officially. (Probably - it's a slightly grey area). If you didn't, you shouldn't have been admitted to the USA in the first place. In the event that you were, going to Canada was OK as long as you don't seek readmission FROM Canada. You've slipped through the net.

    Basically - you cannot do a one way trip to Canada via the USA on a visa waiver unless you are a Canadian resident

    - You cannot get a new or extended visa waiver by going to Canada and going back to the USA
  • and upon return to the US you would probably face more of an interview regarding your visit
