CapQuest Debt Recovery ???
Comments
-
I found Capquest to be hideous, and they didn't know their bums from elbows.
I had a debt with Capital One passed over to them, and after attempting to pay it in full was passed from pillar to post (capquest, to C1, back again, back again) until Capquest sent me a F&FS figure. Paid that, thought it was all over.
No, it's still down as part settled on my credit file. Booo.0 -
Capquest are a pain in the rear - they told me I owed Natwest £14k (which I do) - but they also told my hubby the same (which he does as it is a joint debt)
But wanted £28k paid back - complete idiots and rude with it0 -
Ok you need to understand that there are some people on the net that work for parasites like Capquest and are employed solely to trawl through forums and talk up the companies that they represent but in a very covert way,
Capquest are the lowest of the low. be under no illusions. Put the word Capquest into google and spend the next week solid reading about there evil tricks and regular trips into the world of illegal trading.
YOU REALLY MUST read up on these vulchers, understand the law better than they do and you may be in with a chance.
Do not under any circumstance talk to them on the phone, have all dealings via letter only, they will threaten all sorts but stick by your guns.
insist on what you know you can afford to pay and no more, then when you have read up on the subject and are suitably armed, you can join the mass army of people that are currently ammassing to fight these pirates.
I wish you well in your endeavours.0 -
I wondered if anyone could help me - I have received a letter were capquest have mentioned that my original debtor has a CCJ against me? I was not aware of this -to have a CCJ must you have attended court or can you have a judgment without attending court?
I am confused, also the debt is far higher than I could have ever imagined - should I write asking for a statement - I only have a short amount of time to do this.
They have given me three options of 1) a charging order - to secure a charge over my property
2) attachments of earning offer - to work with my employers to pay part of my wage direct to them (CAN THEY REALLY DO THIS?)
3) warrant of exceution - Balliffs
I am worried as my partner is disabled & I am his only support - and I am worried that the stress of all of this is going to make him worse.
they said I can stop all this with a phone call - but how do you know if it is genuine with so many dodgy companies about & personal & debt information being so accessible.
Please can someone offer me some quick advice0 -

Crapquest are lying through their teeth and some, unless their letter contains the weasel words "action which may include ...?"

Can anyone help please, can I send a CCA to Capquest who have bought my RBS debt when I had a CCJ from RBS 7 years ago? Capquest are now saying the debt is nearly 3 times what i originally borrowed even though I paid 1 years of payment before defaulting0

Don't worry. From what you have just said the Debt is Statute Barred or nearly. What communication have you had with them? and when did you last make a payment or acknowledge the debt in writing?
Keep all communication with them in writing and only use a digital signature.

From http://www.payplan.com/debt-library/joint-and-several-liability-the-limitation-act-1980.php
County Court Judgement If the creditor has previously taken you to court and you have received a County Court Judgement, you will be unable to use the Limitations Act 1980 to dispute the debt. If the judgement is over 6 years old the creditor may need the permission of the Court to enforce the debt.0 -
