You wont win if you contest. You have a much stronger case if they sent you a email to say they accept the order then take money.

Honestly it was a mistake we all knew it. If you accept it and you get the goods for free, great if not theres nowt you can do to force them
  • well the thing that irritates me is this....
using the bouncy castle a week or so ago as an example - misplacing a decimal point etc is understandable. (i.e 70.00 becomeS 0.70) typing in a completely incorrect price is not. i'm no expert regarding the systems they use, but a)it says "FREE!", and not just 0.00. and even if it did say 0.00 and not free, somebody has typed that in, i'm sure. which makes me think its a marketing ploy to get lots of visitors to the site.

Unfrortunately the key to having a fighting chance with any misprice on any website is only when money is taken, thats when a contract is formed between parties. As its advertised as free they were never going to take money so there is no contract.

With the recent focus bouncy castle misprice I believe some people had money taken, they would have a chance to argue their case.

If a company like amazon suddenly listed every item for 1p, they would get thousand of orders but they can cancel them all. But,if they took money for the 1p items then they have formed a contract with you and should supply at that price.

A price advertised anywhere is "an invitation to treat" which means the retailer is inviting you the customer to offer the price they are advertising, theres nothing stopping you offering them less ( ie car showroom ) They may accept that.

So in the case of items advertised for free, I dont think there is anything anyone can do to make them supply as they dont legally have to.

    Money taken = contract formed

    Dear Sir/Madam,

Due to a system error our large printed canvas was shown at £0.00, rather than the correct retail price of £49.99 on our Dunelm mill website.
Having consulted with trading standards, we will not be honoring this price due to the nature of the error and will be canceling your order.
We apologize for any inconvenience we may have caused.

    Yours sincerely

!!!!!! huh??? not impressed but kinda expected it!!1

Havn't had the email either yet but knew it would happen as happened before with the quilts. They shouldnt keep making the same mistakes though as there was loads of things priced as FREE the other day.
  • it just doesn't seem to be a simple error, thats what's irritating me. loads of unrelated items (vase etc) all "accidentally" marked as free?? hmmm....
