Car Insurance query - please help

Hi,
I am in the process of getting insurance quotes for two cars. I am following the advice on the site to try to get the cheapest possible deal.
However, my husband was involved in an accident in Nov last year, other party's fault (who was actually insured with the same insurer). It has been a very long process due to Christmas and then the insurer sending the cheque to a random address and it having to be reissued. There is still a small personal injury claim ongoing (although my husband has signed part 36).
My question is this, what happens about our NCB which will be at 3 years when the policy expires at the end of this month? Do I complete forms saying I have 3 years or none at the moment? I really can't afford to have to pay more and then get a refund.

Has liability been established?
If the liability has been agreed as not your husbands fault then he should not lose his no claims.
He would get a renewal notice with 3 years on if this is the case.
Have you not had a reneway notice yet?
If no then chase it up and ask what no claims will be whilst on the phone.
If you have it, then what does it say his no claims is? If it says 3 years then there is no problem.0 -

The renewal, which was through a broker, was for our old car and states only 1 year NCB. When I queried this they said that it was because the claim was still opem.
I called the claims dept who said that it is still open and therefore I would only have one until it is settled. I told the chap that I was not in a position to pay a higher amount and then get a refund - and to be honest I don't see why I should. He said he will try to get this sorted out today.
