Petrol Station Dispenses Wrong Fuel

A friend filled up his van on Monday with diesel at a local, nationally-known garage, only for the engine to blow up minutes later. The garage has found a tank full of petrol as the cause, but the time-stamped receipt cearly states diesel. The garage denies any responsibility, and my friend is willing to sue: what evidence can he gather to prove this in a court?

Thanks for your help.

If the petrol station was dispensing petrol from a diesel pump then there will have been quite a few others that this has happened to. If he finds others then the garage doesn't have a leg to stand on. How he finds these others would be down to other people hiring solicitors to fight the garage in question, and the solicitors aquiring this information.

Get him to see one right now.

Looks like your friend will need to make a large fuss, go to local papers and find out if anyone else has had the same problem with that fuel station.

Go ASAP back to said station, and buy from same pump 5 litre can of "diesel" if it happened it would have happened to lots more customers.

If it happened on Monday they will have changed it by now.

You need legal advice but it might be worth calling the HQ of the chain to report it and ask for advice, at least then they can put the wheels in motion.

OP should definitely contact the press and let them know how Tesco treated his friend, as they clearly didn't learn from last time:
Tesco initially denied there was a problem before it emptied its tanks at 150 outlets in the South East.
