Capital One Credit Cards

Hi, I wondered if anyone could give me guidance please.
I got into trouble on my repayments to Capital One around 2003 - 2004.
I wrote several letters to them and kept getting replies from various offices. I used to be an accountant so i really laid into them insisting that they reply and acknowledge the letters I had already sent to them.
I eventually received an agreement on a monthly amount and managed to get the charges stopped but still continued to receive nasty letters.
I had set up repayments by monthly standing orders and never defaulted on this.
Sadly, in October 2006 I suffered a major stroke which meant that I was retired from work on the grounds of ill health.
My speech was affected and my daughter acted on my behalf for phone calls etc.
A couple of months after this I received another nasty letter about my payments. I rang and tried to explain to a young lady who insisted on giving me the usual spiel. I got into a state that made my speech worse. She insisted they would remove the agreed amounts and restart interest charges.
This made me very ill so My daughter rang them and demanded a manager.
At first he refused to speak to her even though I had given verbal permission.
Eventually after she had made several threats about their behaviour, and threatened to take them to court for harrasment she was able to get them to agree that the amount per month by standing order continue.
My question now is this: most of the outstanding balance is due to charges levied during the period I was trying to get agreement for a redyced monthly payment.
Does the letter templates cover this. Sorry to appear thick but my mind is nowhere near as bright as it used to be and I find things difficult to understand or, during phone calls to remember what was said at the beginning of the conversation.
Any advice/help would be much appreciated. Thanks.
