Hello all,

I have a problem that is failing to go away.

My wife and I phoned ETOO because they were on the TV to sell our Timeshare. They phoned back later and said that they had a buyer for our timeshare and we are to pay a upfront charge to get the ball rolling.

£850 was the charge and we paid with our credit card, as instrusted by our sister who works in a bank. We were under the impression that if anything goes wrong then we could claim our money back.

They are not answering our calls and when they do they say that it is still going through. We are well over the time they said it would take.

We then instructed our credit card company to start re-claiming the money. They asked for proof that the company had gone bankrupt but they are still trading.

ETOO have our money and the credit card company are doing nothing about it.

Please can anyone help:confused:

  • sorry but anywhere that asks for a fee up front with no proof of product/purchase etc like this or it's common with selling cars etc is a SCAM.

    Get onto the cc company again and tell them that it's irrelevant that they;re not bust but they haven't fullfilled their side of the contract. Tell them that you will be chasing the cc company for the money as they are equally liable under s75 of the consumer credit act.

    Companies house site say they are dissolved-have you looked at that.And they have been in liquidation once before...did you not think to check them out?
    It sounds very similar (what do I know,I am not a Lawyer!)to the scam where you advertise your car and someone rings you up saying they have buyers lined up-and that is (just) legal.

    As per Blacksheeps advice WRITE the credit card company using Section75 of the consumer credit act and after a House of Lords ruling last year this even covers overseas transactions which yours probably was, as this company is Spanish and would still seem to be trading there

    You will need to be able to prove,
    1. What you were promised. A written agreement is best but in your case you may have to rely on what you were told verbally
    2. That you paid more than £100 by credit card (or borrowed to finance). Which you can from your credit card slip/statement although the card company should know this !
    3. That you did not - or cannot - get what you bought or were promised. Evidence of this can be in a number of forms
    In your case formal evidence a diary record of your attempts to obtain the service promised, I assume you kept track of your phone calls/letters to ETOO will do

    I did have a recipt for what I paid but lloyds asked for theproof and now they have lost it.

  • Unfortunately I too have been bitten by the ETOO bug. I never give my credit card details over the phone unless I am in regular contact with the company but when you are answering an advert on the T.V. you think everything is o.k. I am in the process of trying to get my money back from C.C.Company

    You need to be relentless in chasing the cc company. If you have all of the evidence, then look at small claims to claim against the cc Company.

    Keep chasing. As with many other things, companies will continue to make up excuses in the hope that you give up.
