Store/Staff Card - Can they do this??

Hi there, need peoples advice on this one!!

My SIL works for a dept store who had a one day spectacular a while back, staff can purchase goods a few days before, to ease the crowds on the day, my SIL brought well over £600 worth of stuff (after discount) and thought nothing more of it, she has now recieved 2 letters stating that she has had too much discount taken of her items and she is required to pay this back. Can they do this? If it was on ordinary store card im sure they wouldn't! Any help/advice would be really helpful!!

was there any terms and conditions to the offer?
  • Not as far as im aware, you have a credit agreement when you have the staff card, but she didnt know what was the 'right' discount for items, as they werent marked up and had to be taken off manually!

  • She was allowed to have the spec discount and staff discount, but they reckon too much discount was taken off and now they want it back. What im saying as well is, if this was a 'normal' customer on a 'normal' store card, they wouldnt do anything!

  • On the other hand they could argue that as a member of staff she should have known that the discount applied was 'wrong' and in real terms she has attempted to defraud her employers.
I think she has to think very carefully as to her next course of action - IMO either pay back the 'extra' discount or take back the entire order and get a refund. That way the employers get to choose what they want her to do.

The fact that if this had happened to a 'normal' customer is not relevent IMO.
  • I'd have to agree with ejones999. If she stands her ground, her employers might take a pretty dim view of it. That also might cause problems at work for her generally. I'd write back explaining the details, i.e. no discount tags displaying the %off on the products, manual application of discount, etc, and offer to either return the lot for a full refund, or pay back the discount but only after going through it with a fine tooth comb.

What's the problem ? She got the goods with double discount, an error was made so she gets them for the price she should have paid.
    Nice to save.
