Can anybody help? I don't want a CCJ!!!

Some of you may know I am on a DMP with Payplan. Being silly I missed a payment on my account the month before last.

I have 4 debts.........1 egg loan and credit card, 1 cahoot flexi loan and a Barclays overdraft.

The first three debts have been passed to DCA's now but i'm not to concerned about that at the moment . Payplan have sent them my SOA. It is the overdraft I am worried about.

I received a letter from Barclays Collections and Recoveries department yesterday basically stating that I have ignored requests from "Central Debt Collection Services" demanding payment. I've never heard from such a company regarding this debt.

Also on this letter the say they are "preparing papers which will instigate legal proceedings through the county courts"! Are they just trying to scare me or what? They are demanding nearly 3k from me which I cannot afford!!

Shall i write to them? Defaults don't really bother me but it's just the idea of court. I don't know if I can cope going there.....

If I don't pay immediately "an application will be made to the court and i'll be liable for the costs incurred" apparently as well as more intrest!

Sorry for the long post but what do i do now? I'm back on top of my payments now. It's not like i'm ignoring the debt is it?

  • Have you contacted Payplan?. We are with payplan and they have been brillant, we are going through ccj's at the moment and payplan have been such help with us.

    So once the "papers are being issued" there is no way back? Or can I stop it now. If they want more money per monthe they can have it!!

    Not unknown for Barclays and debt collectors to lie, stating that they have already contacted you when they haven't. It's probably just another tactic to put some "pressure" on you.

    Most likely to be a scare tactic. What do PayPlan think?

    If you just make an offer to pay by instalments then you don't have to set foot in the court. It's all done by post.

    There is only so much and certain types of interest that can be added to a judgement.

    Hope that helps, but please discuss this with Payplan.

    Unless they advise otherwise you should continue paying through them.

  • Hi Loubie-Lou if you give one creditor more money you have to treat your other creditors the same,that was what we were told by Payplan.

    I suspect its a threat, I have had letters worded that way in the past.

    Just take it one step at a time, no point worrying too far ahead it won't make it stop happening but you could have wasted a lot of hours worrying if it turns out to be nothing.

    Have you ever claimed back any bank charges, just wondering if you had or not as you could wipe out most that debt - I don't know much about it but why not ask on the relevant board.

    Well, I'm sure it's not the first time they've had this happen to a case they're handling. So they should know what to do, and how seriously to take it.

    I don't know if you post on it or read it already, but there is the DMP Mutual Support Thread (Part Three) thread here on DFW.

    I don't look at that much myself, but you can guarantee that lot's the other people on DMP's with PayPlan or CCCS have had just about everything threatened by creditors impatient for their money.

    EDIT: rayday2 at the very least has, it seems............

    Hi Loubie_lou,

    Great advice by fermi as usual! As already mentioned, it could be a scare tactic by them to try and get you to pay more than you can afford. The creditor is however well within their rights to apply for a CCJ against you, but providing your offer of payment is realistic it will be accepted by the court, and it will be dealt with via post.

    I would just urge you to keep on top of your mail so you are aware if you do receive any blue and white court papers, as you only have 14 days to send the papers back with your offer.

    Just emailed my case officer and had a reply back already!

    Basically he has just confirmed what you guys have said. So that's good, I'll just play it one day at a time.

    Rayday................Barclays owe me a bit of money in charges but they've put it on hold so we'll se what happens when the OFT ruling goes through.
