Brand new - but is it sealed?

Hey.
Recently bought a phone as a present for my girlfriend advertised as "BRAND NEW IN BOXED" and unnused.
On receipt, the seal had been broken, and box a little worn.
There was nothing in the description to suggest the product had been opened before as just advertised as brand new.
Is it up to the seller to explain the seal has been broke when saying "brand new" as i believe this is IMPORTANT information. When giving a present to someone it has to be sealed really...

Well... it's brand new, and it's in a box. If I was selling it and it was sealed... I'd have said 'sealed'.
When I get a phone upgrade, the guys in the shop open up the box set it up for me.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I always thought there was a difference between new and and new and sealed. So long as it's not mentioned that it's sealed should not be a problem.0

Maybe we should make a list of ebay 'Reading between the lines' phrases.
'Comes from a smoke-free home' - covered in pet hair
'Untested' - completely broken
'Worn a few times' - I got rid of it because the elbows were getting thin
'Sold as seen' - something wrong with itMy TV is broken!

I sold a brand new mobile phone last week and I opened to box to cover myself, to be honest, so I knew that everything was present and correct and I wasn't going to get some buyer telling me things were missing :rolleyes:0

pretty standard practice if they got it instore to open the box so unless you asked if it was sealed or there is something missing theres not much to sayYes Your Dukeiness

^i wouldnt necessarily say so, boxes have to be stored in a stock room and can be there a while before theyre sold, wouldnt say its very indicative of much unless once again they had said that the box was in good conditionYes Your Dukeiness

I would in any event having bought a phone on ebay (to give as a present) check that it was all working so would have broken the seal myself. I havent read the whole of this thread but did the phone look new and untouched when you opened the box.
I would get one of those mobile phone trinkets or something to personalise the phone like putting a message on the welcome screen or downloading a favourite ring tone to make the gift that extra bit special which gets round the seal broken bit
You could also buy a fancy gift box to put the phone in so its a complete surprise as to what she is getting and this gets round the damaged box.0
