Im sure this has been asked before but i cant find it
we are renting. this morning we opened a letter addressed to the occupiers and it seems our flat is being repossed and a court date has been set where do we stand other than outside in the cold.

contact the lenders and inform them of your presence as tenants. If the owner had a BTL mortgage or had obtained consent to lease, the property would be repossessed with you as tenants and sold with you in it. Expect to get notice leave at the earliest opportunity allowed for in your tenancy.
If the owner was letting to you on a residential mortgage, the lender won't acknowledge your presence and you would be evicted at the point of repossession.
Of course, a letter is just the first step on the path. Enquire of your letting agent or landlord, why the mortgage hasn't been paid and whether the matter will be sorted or not.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. 1) Judging by what has happened to other people on this forum don't trust the LL or LA to give you the truth. Get in touch with the lender's lawyer & ask them to keep you informed.
2) Having said that do get in touch with the LA & LL to see what they have to say. They may be honest & straight with you.
3) Attend the court hearing to find out when you'll be evicted, ask for more time if you need it.
4) Find somewhere else to live, pressure your LA to do this for you for nothing. Their !!!!-up after all, not checking the LL was in a financially secure position."Mrs. Pench, you've won the car contest, would you like a triumph spitfire or 3000 in cash?" He smiled.
Mrs. Pench took the money. "What will you do with it all? Not that it's any of my business," he giggled.

We are renting direct of the owner. He only brought the place just before we moved in and told us he wanted a long term as this was his retirment fund0
