incapacity benefit help

hi my son has been in a car accident july last year his ssp stopped after 28 weeks, he has been awarded dla both components lower rate, at last we have been told he gets incpacity of 61.35a week short term lower rate shouldnt he be getting short term higher as he has been off work more than 28 weeks? any help much appreciated

Yes...however-It looks like in 1 of the 3 tax years needed to qualify for IB, there is not enough National Insurance conts are recorded - namely the 04/05.
Ask JCP to confrim this, and then ask your son to find his P60 for 04/05, and send a copy of it to JCP. HMRC may still be behind in putting everyone's 04/05 onto the NI records.
If 04/05 is correct, so is the IB rate of £61.35, as it would appear he only has paid enough NIC for tax years 05/06 and 06/07- assuming he claimed IB after 6/1/08.0 -

There should be a premium on the benefits if you're getting DLA. Get advice from Welfare Rights Service !

Yes, there is, because I'm about to lose it when my DLA is stopped. I had this confirmed by a Social Worker today. Of course, I suppose even they (gasp!) could be wrong.

thankyou for your explanation, why didnt they tell us this?? he wasnt working for some of 04/05 and didnt sign on, he hasnt got his p60 for this year any other way to find this out ? its all very confusing
at the mo i lost my 25% discount for council tax and get 15% instead now , if on income support i would get it how about incapacity? it is only myself and him in the house

If you have a Credits Only claim with IB and receive Income Support as a result then you will lose the Premiums from the Income Support claim.0
