Break 6 month rental agreement?

Hi guys,

Probably not really going to do this, but... We sold up in December and moved to rented, with a 6 month minimum tennancy. Then, in January the house of our dreams came onto the market, and our offer was accepted - subject to us progressing quickly.

So... we're planning to move in early March, with 3 months rental still to pay. Are these tennancy agreements binding, or negotiable in any way?

We're actually committed to paying rent and a mortgage for 3 months, but just interested in any comments.

    I would call the LL and sweet talk them , they could be negotiable , depends what they are like and what mess they may or may not be in with you leaving early

  • Usually if you want to terminate early you have to pay the re-advertisement costs and pay rent until a new tenant is found.

    Have you considered exchanging on your new house ASAP but completeing a little later?
    LL's get abit of stick on here, but it is a two way street. Play fair and I'm sure there will be some room for negotiation.

    you are legally committed to paying for the full six months. But as others have suggested if a tenant came to me in this scenario, as long as they paid for advertising for a new tenant, and were willing to do tenant viewings, i would be willing to TRY and end the tenancy early. BUT, i would still ask them to pay the rent until a new tenant was found, even if they had moved out.

    i think you have to be prepared to look at this from the other end of the stick - if the landlord wanted to kick you out after 3 months how might you feel - and would you expect him to help you to find another home ? renting is a two way relationship - and communication is the key.

    It's worth speaking to your landlord. The tenant before me was a young man who found himself out of his debt depth ... and turned up at the landlord's without notice to say he was moving home to his mum's. Landlord tore up the agreement and let him go soonest. No penalties.

    There are some out there that are trying to treat other people as they would hope to be treated in the same situation.

    I had a similar situation a few months ago....was in a 6 month contract but it was quite important for me to move. I called the LL up, explained the situation, and let him know that although I wanted to find a new person I still considered myself fully committed to paying the rent for the rest of the contract. He advertised himself, and I placed ads on the Gumtree for potential new tenants, and we found someone within a few weeks. Although I had to pay for his advertising costs and time we were both very happy with the situation. So I'd say definitely worth a shot contacting the landlord and seeing what happens.
