UK Default Recovery-Sorry if in wrong area

My OH has received a letter from them saying he has a debt of £214.04 and they want immediate payment. It is headed CL Finance -v- Mr XXXXX case number XXXXX.
I remember seeing someome advised on a template letter on what to send these types of people but I can't seem to find anything now. I think this may have something to do with a dca that wrote to us back in 2007 they were collecting on behalf of a Newcastle court. They were saying that my OH had not turned up to court in Newcastle on a fare evasion charge and so had been found guilty he therefore owed the fare cost and court costs. We wrote to the courts and asked them to send us details we also asked that the case be reheard as my OH didn't live in Newcastle at the time the offence happened. But them nor the original dca company got back to us in writing. so we ignored it even though dca told us there was a warrant for his arrest. I gather this is a lie as he has given his name and details to police since and not been arrested.
Could someone please point me in the right direction of a template letter. Thanks

    The letter you refer to is for consumer credit, so would not apply to this situation.

    Does the case number refer to the court number or is it just a number used by the DCA?

    I would go back to the court, check out the details etc. If they are chasing the wrong person (sounds quite possible), then inform the Information Commissioner.

  • I'm not sure about the case numbers I'm afraid I'll have to dig out the paper work and check. Thanks for advice I will write a letter to this dca asking why they are writing to us. Thanks

    Contact the court in the first instance. The DCA are unlikely to be the least bit interested in whether you owe th money, they just want it paid by someone.

    If the courts do not come up trumps then I would send a Subject Access request to the DCA.

  • Thanks, I'll sort out the paperwork and write again to the court asking what has happened and what can happen. I don't know what a Subject Access request is but I'll worry about that if it comes to it.

    We have now found out this has nothing to do with the Newcastle court case. I wrote to UK Default dca. Telling them I had never heard of them or CL Finance so would not be ringing anyone. I also told them that I certainly owed no money to either named party. I wanted all corresspondance in writing from them and I wanted a reason as to why they think I owed £214.04. Since I sent that letter OH received a letter from CL Finance saying congratulations he had been selected to receive a chance to only pay £60+ off the £200+ bill. Saving a £140+ !!! I have written to them saying I wouldn't be taking them up on their idea of a wonderful offer as I do not owe them any money. This morning we received a letter from UK Debt saying the amount is in regard to a Yorkshire bank account OH had a few years back. Please can anyone advise what we do now. He doesn't know his account number for that account all we have is the address he was living at when he opened it. I have read on other threads of people being advised to pay the original company instead of the dca. I have no idea of what is the bank debt or if anything has been added by the dca's. He has not lived at the address for at least 2 nearly 3 years. Thanks if you can advise me I'm very grateful.

    When did OH last pay anything into that account or use it in any way?

    And have you checked his credit records with the credit reference agencies?

    Showing on his Experian report (not checked any others) is Yorkshire Bank current account. The Special Instruction Indicator shows as Debt assigned, Default balance is showing as £129, Overdraft Balance shows as Satisfied and account defaulted on is 05/2005, file updated for period to 15/10/2006.
    Should we write to Yorkshire bank and apologise for this debt and pay them the £129 although until I speak to OH I'm not sure how he owes this if overdraft balance is satisfied!
