DLA Refused....help!

  • Hi Penny Pincher, I had a consultant 18 months ago but after trialling me on some injections (which didn't work) he said there wasn't anything else I could be given, it was just a case of management rather than treatment.

    I think I might investigate getting a copy of the IB doctor's report as it would be pretty helpful to have one doctor on my side at least I think!

    The notes on my GP's file should have been enought to back up what I have said on the DLA form, however she failed to include any of it!

    I might see if I can get my notes from 2001 to the present day - is that possible or are doctors notes kept private does anyone know??

    I am pretty sure you can request them and think its a charge of £10. It may be worth getting all your medical records as far back as you can go, just so that you have some kind of referance.

    Get as many people as you can on side and to write supporting letters. I even scanned copies of my blue badge, Stannah Stairlift receipt, house adaptions recipts and a letter from the council stipulating my care needs.

    DLA can be difficult to get, but do appeal as you sound like you do qualify but the DM's have been misinformed (sp).

  • I think it is a good idea to go back to GP and take someone with you. When this happened to me my daughter went with me and she explained that as I am a very positive person, I don't complain too much and don't want to use up valuable time for the GP. She then went on to tell him all I couldn't do. He did listen to her and did write another letter to the DLA telling them more about me, so it might be worth a try for you

    Thanks PP, I'll try and get all my medical records to back up what I've said and copy my blue badge too (although this runs out the same time as my DLA in May).

    Hi Springs, I think you might be right. She's on holiday at the moment but I think I'll try and go when she's back to see if she'll include more information about me.

    Your situation sounds very similar to mine. I usually try to get on with things and live the best way I can without being too negative, as negativity only worsens your conditions. I don't like whinging about how ill I feel or how much it hurts and just muddle through. But I think maybe it's time I did!

    I think you should definately take this as far as it's possible to go, although I don't think speaking to the GP is particularly useful. GP's rarely give good medical evidence, even those with previous knowledge of a patient. This is rarely through malice but bear in mind how many people they deal with on a monthly basis, its likely that she simply referred to your notes which would not go into detail about you to the DWP's satisfaction-which is exactly why they will stick to an unfavourable report like glue! I don't really blame doctors, I cant say I would want to get involved in these matters beyond giving basic factual information myself. I think your effforts would be much better spent submitting further evidence from other professionals.

  • Well I went to the CAB this morning and that wasn't very helpful. There wasn't anyone there who knew about DLA appeals or claims so they just gave me a leaflet with a bit in the back to fill in and return to the DWP.

    However, I've requested a copy of my IB medical exam from last June and I'm going to submit that as extra evidence. I've also requested my medical records from the doctor which should take a couple of weeks and hopefully it'll be in time before I need to send everything off!
    I've got an appointment with my GP on Monday too so hopefully after I've explained everything to her, I might be able to persuade her to write another report with more details and submit that with everything else I have.

    I can but try!

    Good luck to anyone else who is having the same difficulties. I was a bit disappointed that the CAB wasn't able to do more, but if they're not experienced in that area then I guess it's up to me to try and be proactive.

    I'm afraid I dont agree with this! If it wasnt for my GP, I wouldnt be receiving half the help I do. He was the one that suggested asking SS for help, filling in the BB form for me, getting me a wheelchair, refering me to numerous consultants etc etc. Alot of people dont like him as he tells it as it is and if he thinks there is nothing wrong with you...he will say. The supporting letter I received from him in support of my DLA claim was fantastic.

    Maybe I am just very lucky, but mine honestly has been a god send.

    I am sorry to hear that CAB couldnt offer any help. Over the weekend write down what you want to tell your GP, the meds you take and why you take them, who you see other than him and what the IB doctor said to you last year. It should all help. It wont worsen the situation anyway.

    Thanks for that, I'll have to have a good long think about what I want to say as I do get muddled up quite easily when put on the spot!

    I think the CAB is probably helpful if you live in a bigger town maybe. It's a very small one where I live.

    I don't agree with what penny pincher says about not seeing GP, I had a brilliant report from my OT but DWP took more notice of what GP had to say and that wasn't very much which is why I was turned down.
    Do you not have a disability rights group in your area? cab would know if there is, check yellow pages? Once you have returned your form to say you are going to appeal you will have plenty of time before you go to tribunal to get all info together so it might be worth looking around for help.
