Will the LL keep our deposit?!

Hi guys,we have just been given the ok to be able to move into another private rented property, it's £150.00 pcm cheaper than the one we are in right now, all there is left to do is lend the deposit and rent advance from MIL then current LL a month notice then move in. However, the reason we were looking for cheaper rented accommodation is because we just weren't coping with our finances very well, so we are in arrears with our Gas and Electric, and with our telephone bill and broadband. My question is, As long as I tell the companies we owe the money to our forwarding address and carry on paying them, will our current LL still withhold our deposit? 
We really need the deposit back to pay OH's mum some of the deposit back she'll be lending us. Thanks guys.

LL will probably withold it. There's something in shorthold agreements about this normally.
You don't need the deposit back to pay your OH's mum, you need it to pay your gas, electric, telephone and broadband!!

But if I inform gas and electric company that I no longer live there and will continue paying the arrears from a different address surely the slate would be wiped clean from this address.Probably. There's something in shorthold agreements about this normally.

your utility arrears are nothing to do with your LL - he cannot with-hold your deposit because of this - your payment arrangement between you and the utility companies are none of his business - Data Protection Act and all that.

Moved in 1st April 06 signed forms day before, it does say in the contract that we are to keep up to date with payments for utilities, God i'm panicking now!! Not correct.
If it is in your Tenancy Agreement that all bills shall be paid by the tenant before the deposit is returned, then the LL can withold the deposit until proof of payment of bills is provided.British Ex-pat in British Columbia!0 -
No he can't the deposit is there for dilapidation he has no legal consequence if you do not pay your utility bills and its none of his business how you go about repaying your utility arrears.0

a lawyer and a landlord so far have told me you are wrong , you should think before you give false info on the www in my opinion
