Hi hope you are all well
Have a query and am hoping to get some light shed on it.
I wrote to my agency to request the LL name and address via recorded delivery ( this was last year 6months ago)
anyway they didnt respond, i metioned the law and the 21 day rule.
This was a recorded delivery i knw they got it becuase it was tracked and signed for.
i went into the office weeks later, ended up chasing them on their doorstep so they gave me the address. if your wondering No it wasnt on the tenancy agreement, the agreement was with another agency who passed the job over to them.
since i got the address+name in the end after all the effort should i report them to the arla??, they could be fined £2500 (i think)
where does this money go? and can i still report them 6months later even if i now have the address?
thanks

Which law did you mention? I think the HMO management regs do say that you are entitled to know the LL name and address. However we generally accept the LL name, care of the agent as being OK.
Under what legislation can they be fined £2,500. You may be right but it seems unlikely to me. Remember that ARLA generally exist to protect the interests of their members, although I guess they must have a code of practice. If anybody's going to prosecute I doubt it will be ARLA. If anybody it'll be the council but I doubt you'll have much chance there either.
When you say, "where does this money go?", what money are you talking about? The fine?0 -

law metioned " section 48 ll and tentant act 1987, section 1,2,3, ll and tentant act 1985"
the act here for example for the fine part
"
1. DISCLOSURE OF LANDLORD’S IDENTITY
(1) If the tenant of premises occupied as a dwelling makes a written request for the landlord’s name and address to—(a) any person who demands, or the last person who received, rent payable under the tenancy, or any other person for the time being acting as agent for the landlord, in relation to the tenancy,(2) A person who, without reasonable excuse, fails to comply with subsection (1) commits a summary offence and is liable on conviction to a fine not exceeding level 4 on the standard scale. ""
that person shall supply the tenant with a written statement of the landlord’s name and address within the period of 21 days beginning with the day on which he receives the request.
the fine i had was £2500 i thinks its a ARLA thing, but you have to do it by reporting to the council ombudsman,,???
i'l try post the it if i cant find it online
yeh i meant the fine money, where does it go? to the council i guess?
thanks for your reply0 -
"exceeding level 4 on the standard scale" is the value of £2500 and no more.

Oh the landlord and tenant stuff is interesting. I know very little about that but perhaps I should give it a read.
Your council will probably have some sort of housing advice service who would be able to advise you about this sort of thing. I'd give them a ring.0
