For two debts both hubby and I are disputing. The DCA's in question are a total bunch of t**sers and I'm both petrified and excited about taking them on.
I guess its just a waiting game now then? If they produce the cca's I dont know where that leaves us. Up sh*t creek without a paddle I guess!

Good luck but please expect at least two and possibly three letters from the DCAs suggesting that they are now referring the account for consideration by their legal department, or that they now want to offer you a spring discount of 60% if you pay two days before the CCA deadline etc.

Is there a link to the main site for the CCA topic and sample letters? Apart from credit cards and loans what other agreements are relevant for applying for CCAs?

Ooooh....guess what? DH had a call last night from the dca trying to get £5k out of him for a car he gave back to Yes years ago. They want this money but wont provide us with a breakdown or explain what the hell its for etc. We're a bit iffy to say the least.
Anyway, they phoned my hubby last night. Asked him to pay the full balance blah blah...hubby told them he wouldn't be paying anything as he is disputing the debt etc and asked them not to call again. Good boy lol! They wouldn't take no for an answer so dh got a bit angry and asked this woman if she could prove it was his debt and apparently she went quiet! He then asked if she had a true copy of his cca with his signature etc and she said no they had nothing with his sig...she then said COULD YOU SEND IN YOUR SIGNATURE ON A PIECE OF PAPER SO WE CAN SEE IF IT MATCHES OUR RECORDS!!!!!!! So, firstly they dont have a signature (or anything for that matter), then they do have his sig and want to see another one to 'compare'. Yeah right! This woman eventually said they would pass the account back over to wherever they got it from at that point and hung up pretty sharpish. Before she went hubby asked her if they'd recieved his letter - she said no but I checked the RM website and it had been delivered yesterday morning.

Just quickly - if they do pass it over without providing a CCA, where do we stand? If they don't provide a CCA the debt is unenforcable. They'll probably keep passing it from DCA to DCA in the vain hope you'll pay up.Total 'Failed Business' Debt £29,043

If they don't provide a CCA, then the debt is in dispute. I though that they weren't allowed to pass it on to someone else if it's in dispute. If they're late, they can't enforce it - if they don't send it at all, they can't do anything because you don't owe them anything.0

It sounds as though you are 'dealing' with an absolute bunch of idiots here.
Once you have requested a cca then you have, effectively, put the 'debt' in dispute and they should definitely not pass it on to another dca:

If they can not provide you with a true copy of the original signed consumer credit agreement within 12 working days of your request then they are 'in default' and would need a Court Order to enforce the 'agreement'.
After a further 30 days they will have committed a criminal offence.
Stand your ground.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Ok, so, they recieved the letters yesterday, so does that mean they have 12 working days as from yesterday to reply to us?
