Need Some Advice Please!
Hi evryone
Have just joined and wondered if anyone can give me some advice. I recently seperated from my husband(Jan 08 ,second marriage)the house we are in is rented from my first husband whom I divorced in 2001, my 14yr old DS from my first marriage lives with me. My X purchased this house after our divorce so I have not had anything to do with the property before renting from him with my current husband. I am disabled and have been on incap/disabilityLA for many years due to Rheumatoid Arthritus, plus many other illnesses that run along side of this complaint. Since my husband left I have not been able to pay my rent so after getting advice from CAB applied for HB / CTB and IS.
I have been refused HB and IS. The IS say I have £5 awk too much, the HB turned me down on the grounds that my son lives with me and government regs state that you cant claim HB ' if you rent from a close relative ' . I appealed against this as my DS does not rent from my X , I do but am still waiting to hear, have tried several times to speak to the lady who deals with appeals but she is never available. My Husband and I have been on the LA housing list for 2yrs+ and now I have to apply in my own name but they will back date it to when we first applied. Can anyone offer any advice of what to do next because if I cant get help then we will end up homeless. Thanks

Will your first ex-husband actually evict his own son?
You need to sort out maintenance issues. Is your recent ex paying you maintenance? Is your first husband, this could be re-assessed if your circumstances have changed.
Being on the LA housing list may not help unless you are classed as a priority need and unintentionally homeless. Priority need should be OK as you have a child with you and are classified as disabled. To be unintentionally homeless you would need to wait until you are evicted and be able to prove that you couldn't pay the rent through no fault of your own. As you said balancing up whether my X would actually evict his own son is a very hard decision. No at the moment I am not getting any maintainence from either the father or my Husband for me. My X was paying until I stopped paying the rent. This was never done through CSA only through solicitors at the time of our divorce, but was never set in stone. My husband is unable to help me as he is renting a flat which is expensive and has to pay his X and also as we went Bankrupt last year, which is why I cant rent from anyone else, he has to pay the official reciever on a monthly basis. But thanks again.0
