Hire Car question

I'm wondering who should pay for the damage to my Hire Car.

My car is being repaired at the moment because somebody drove in to the back of me, wonderful £250 excess payment to start with but I'll get that back .. they are claiming full responsibility.
However I woke up this morning to find that my Hire Car which my insurance company loaned me has been vandelised, some *^%$^ has scrached the front and passenger side of the car. This, from what I can tell, means I have to pay another £250 excess which I can't claim back..... or can I?

Why should I be out of pocket? If I wasn't rear-ended I wouldn't have a hire car. If I didn't have the hire car I wouldn't be paying for it to be fixed. My car has been untouched in this area since we moved in 18 months ago. It has to be because it's a newish black car and not a 6 year old car

One new hire car + One Mindless Idiot = big scratch = Out of pocket.

P.S.
Why do people (kids) do it, I can't see what the "thrill" is.

    Hi,

    That's very unfortunate, but unless you have paid an extra Collision Damage Waiver (which I'm sure you would know about) to the hire company, you WILL have to pay another excess.

    You CAN'T claim this back from the driver in your first incident - he/she is not responsible for this loss.

    Whilst I can see your point about not having any damage done to your own car, as you say, these eejits who do this type of damage are mindless.

    Whilst they MAY have done the damage because it was a shiny new car rather than your old one, it is also equally possible that they could have done it because you looked at them the wrong way, that they had had an argument with their mum about whether they can smoke in the house and just happened across the first car they saw, they might have just been whacked off their faces at the time and it mightn't have mattered whether it was new or old.

    It's too remote to blame it solely on being a hire car, and so unfortunately, it's just terrible luck!
