Wont accept my offer?

A debt collection agency phoned me up about a small debt I owe; they asked if I could pay it off over the phone? I said I couldn’t and offered them £100 a month for three months till it was paid off.
They said if I don’t pay the £300 pound now! They are going to take me to court and I will have a further £500 legal fees and court costs.

They said they don’t want the money in monthly instalments and I said I cannot pay, so they said see you in court?
So what are my options on these guys? thanks

    Hi Boogiemaster,

    You should make Token Payments to them and contact the CAB for advice.

    IF you cannot afford to pay it off in one go then ofering them £100 per month for 3 months seems reasonable to me and probably will be reasonable to any court in the land!!

    So tell them that!

    I've had that before - wasn't WestCot was it???

    I owed abut £1000 to a bank from years ago and have gradaualy been paying it off at £40/month.

    Initially they wanted me to pay off at least £100/month and were going to take me to court until i explained that they could do that and the court would see my miniscule income and outgoings and I'd probably get away with paying them back at about £1.00/week!!!

    That's why I only pay £40 now

    There just doing the heavy handed thing.

    Heres what I'd do.
    Phone them up and ask when the court date is, as you have completed your income/outgoings budget and it shows you have a surplus of roughly 14 pence a week and you cant wait to get into court to show them. Then say the £100 a month offer you gave them has run out and is now down to £50 a month for 6 months and any refusal on that, will mean you see them in court with you 14p a week offer. :)

    On the other hand, it will take them at least 7 weeks to get you in court. If you send them 100 now and 100 in a month it will probably be paid off by the time you get the paperwork through.

    Send them post-dated cheques for the £100 per month (if you can truly afford that). Write to them explaining what you are doing and tell them that you would like all future communication to be carried out by post and not telephone.
    Also explain to them that you are being loaned the £100 per month by a friend who is putting the money into your account for you and that if this is not good enough for them, then you will refuse the help from this friend and see them in court with a list of your income & outgoings.

    Don't become their victim. You are giving them the money, they want it. You take control of the situation and tell them they can have it on your terms or not at all. Most of all, show them how confident you are - they'll then accept your proposal and move on to some other poor devil.
  • Dont do post dated cheques, I got a slapped wrist from my bank when I did that. The person I sent it to banked it early, & the bank cashed it. I was livid!!!!

    YOU got slapped on the wrist because the bank couldn't be arsed to check the date? Cool :rotfl:

    They're cheeky gets aren't they.

    OK, skip the post dated cheque idea. But send payment at the beginning of each month. I wouldn't phone the payment through because I wouldn't trust them not to put £300 on in one go instead of £100. Illegal I know, but you would have a hell of a job proving you didn't authorise it.

    Martin did a thread on post dated cheques. Basicly there is no such thing and they can be cashed immediately.

    Yeah Westcot was the name, told me today that i wouldant get any credit for the next ten ten years if i didant clear the debt today as they where willing to give me one more chance?
    I told them i dont have all the money and cannot pay £300, they will have to take £100 a month, they said we are willing to take £150 every two weeks until its paid.
    I told them it wasant possible and would look forward to seeing them in court and put the phone down.

    Two hours later they rang back up and told me they would accept £100 a month for three months.
    I dont get it? thanks for all the replies, youve been really helpful guys
