Should Marbles be doing more for me?

I bought some furniture on credit and paid a deposit on my CC. The deposit was £278

The furniture was damaged when arrived so I refused and asked for a refund. The company said no so I approached Marbles, asking them to get my deposit back.

They have wrote to me advising that they can only refund my money once there has been a settlement of the credit agreement between the company involved and myself. Is this right?

Surley this should have no basis on them refunding my deposit?

Section 75 of the Consumer Credit Act jointly holds liable both the seller and the credit card company through which the goods were purchased with, in the case of faulty goods or non-delivery.

So Marbles is held jointly liable and is as responsible as the seller for refunding the cost as the goods were delivered damaged (faulty).

There's a bit more information on the new ruling here: http://www.credit-card-comparison-online.co.uk/faq/use-abroad/purchase-protection-cover-abroad.html

I would suggest phoning Marbles back and quoting the information on the site above on Section 75 to them.

good luck in dealing with their offshore call centres.

suggest putting your complaint in writing.
  • Thanks so far for the info.

To be honest, Marbles have been quite good so far. I just don't understand why they won't give me the money back until the finance is settled, what does it have to do with them.

I did write to them under the Consumer Credit Act, advising that they have a liability. This is when they wrote back to advise I could only have it if the credit agreement was cancelled.

Think I will give them another call to see their point of view and why they have stated this.

If you brought the items on some sort of HP or 0% for 9 months scheme than I think the 'finance company' you have the HP agreement with is liable for the goods in the first instance (along with the shop) under Section 75 - not the credit card company.
