in Credit cards
Got a real problem with my credit card which I will outline below. I keep getting passed from department to department and always end up in India explaining the situation to someone who clearly doesn't understand! Can anyone here help me on this one....
A family member said they were going to pay some money into my credit card before xmas as a presnet, they didn't say how much they would put in, just that it was going to be a present. I was at the limit of my card at the time. I checked my balance a few days later and noticed some money paid into my account, (£2,800) credit availible now. I used the money to pay off some other debts I had and xmas presents etc. On Jan. 4th I noticed that £1,400 had been taken off my card as a 'sales return'? This then took my credit card £1,400 over it's agreed limit. This was not due to any purchases or transactions I had made.
I was in shock and didn't know what had happend. I spoke to the person that paid the money into my account, and at this point they said they only paid £1,400 into my account, so why did my balance show £3,800 and I was able to use this money?? I spoke to the credit card company (lloyds tsb) and they said that the £1,400 was paid in over the internet and was paid to my old credit card number and for some reason the payment went into my account as double (although only £1400 came out of the other persons account). I can't get an answer from anybody at lloyds about this. All I get told from a 'lovely' woman in India is 'you shouldn't have gone over your agreed limit', it's your own fault. I am now facing letters that ask for a payment of £1,400 to be made to bring my card back into it's agreed limit. Where do I stand with this? Lloyds have made a mistake and paid more money into my account, I was not aware of this, otherwise I would not have used it. I didn't even receive any letters stating what had happend.
I hope this makes sense to someone.

Try writing to them and explaining, I doubt they send their letters to India. Tell them you want to make sure that charges will not be applied for going over your limit, that it won't be filed on your credit record and that you need a reasonable amount of time to pay off the money. Send it recorded delivery so they can't say they haven't received it.I've given up trying to get my signature to work with the new rules, if nobody knows what the rules are what hope do we have?0

Write to them, (I suggest the Complaints Dept) explain the situation, and use the phrase "detrimental reliance". Suggest they raise your credit limit to cover the increase, refund all charges, and allow you to pay it back at an agreed rate....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0

I hope you have stements to show the error?
SUBJECT: CUSTOMER COMPLAINT.
Keep your letters brief and state this occured due to their error. You want any charges that may have been incurred refund and ask for time to pay the balance.
You will almost certainly get a fob off first response. You have to be persistent. If you get no joy complain to http://www.financial-ombudsman.org.uk/"A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi
