Tennent upstairs has flooed my kitchen

Hi All
I was wondering if anyone could give me some advice. I have two issues with the tennant upstais who is currenly renting the upstairs flat via a manging agent through a council placement.
1 She flooded my ktichen in the early hours on Saturday morning my celing has come down and my wood floor has swollen. Who do i go to reclaim the monies for the all the damage this has caused? To cuase further confusion Iam buying a share of freehold with the lady who owns the property upstairs but nothing has gone through yet and ourbuildings insurance is currently held with the freeholder which has quite a big exess on it. Does anyoen have any suggestions?
2 The tennent upstairs is making excessive noise and nuisance ie playing musch at 3am in the morning and havign her freinds who sound like a herd of elephants. I have kept a diary do I put this in writing tot he agent or council?

Contact your home-contents insurer - they'll handle it.I have kept a diary do I put this in writing tot he agent or council?
Council - they may have a dedicated team/department for such issues.0 -

Try and resolve it amicably first through the agent after having a quiet word with the neighbour - she may not realise she's being loud. If it continues after a polite word, then all guns blazing to the Agent and the Council!
I used to live next door to a young guy who was a nuisance but couldn't believe that I could literally hear every single word he said in his flat - told him one day that his alarm clock played the Only Fools and Horses theme and it shocked him that I could hear something so quiet! Sometimes they just don't know they're a nuisance.Almost debt-free, but certainly even with the Banks!0 -

Yes she knows she is a nusance I have already had a quiet word with her regarding slamming of doors and leaving the communal door wide opne. Its mainly not her its her freinds but she has a responsability to make sure they behave themselves. So i think she does realise she is doing it. I will speak to the counicl tommorow morning plus the managing agent and see how we can get this resolved.
Why on why do tennets not behave themselves!!

You should claim on your insurance for damage caused by the water leak. The issue is usually that of the insurance excess.....the first £50 or £100 or £200 of the claim payable by YOU.
The upstairs tenant is only liable for the costs to repair your flat if the leak was caused by negligence on their part e.g. an overflowing bath.
If the leak is due to unforseen circumstances e.g. burst water pipe, overflowing water tank, leaking tap etc which they could not have been expected to know about.....then they are not responsible.
Its one of the advantages of always making sure you buy or rent a top floor flat.......that way you know nobody is going to lea water on you.0 -

She's had her chance then! Certainly my former neighbour's pals were the ones who used to cause most of the trouble as he was the first in that group to get his own place, so the clubs would shut and they would all head back to his to continue the party usually at about 4 on a Sunday morning.
You've tried to be nice - if she can't behave, only one option for her I'm afraid.Almost debt-free, but certainly even with the Banks!0 -

Thank you very much. The tennet upstairs tod us it was her over flow on her toilet but we think it was her bath she has fogotten about it! As she would not let me go upstairs tos eee where the flood was coming from. I guess the agents will have to check where it comes from. I guess its one of these things but I am still not very happy about it!

Yes you are correct my thoughts exactly. SHes young and all her freinds come back as they can't go back to there own houses becuase of parents etc. I do understand what it was like to be young but enough is enough! i have written my letter to the council and they have a special unit that deal with this type of behaviour. Although i must admit she has kept out of my way since yesterday after I shouted at her at 5am in the morning when my ktichen was been flooded. My boyfreind told me that I was qjuite harsh with her but I guess there comes a time when enough is enough!

Surely as you are a tenant and the only damage to your property is that covered by buildings insurance then, surely, it is the landlord who is responsible for getting any works done? There can be no comeback on you for any insurance excess.0

No i own the property downstairs and the upstairs one is rented out to tennets. The freeholder holds the buildigns insurances which we are in the process of buying but any excess gets charged back to us both as in the the landlady who owns the flat upstaris and myself.
