Dvla Demanding £80 Penalty Help!

Hi MM Viewers!

I need some quick help and advice regarding a DVLA matter now that seems to be engulfing my entire life, I sold my old car back in September 2007, I sent of the relevant documents to them to tell them I am no longer the owner of the vehicle, next thing I know they are writing to me to tell me I haven’t re-taxed the vehicle and I owe them whatever the penalty was at the time, probably £40 or something, now at the time I sent it off was during the postal strikes and I do seem to remember newspaper articles saying they lost loads of info and so on, now I wrote back to them immediately and as luck would have it I actually scanned my documents before I sent them away (as I do with most important doccs, so I printed it out and sent it back to them registered post, I also faxed copies to their office, I heard nothing back of them until I received another demand, once again I collated all the pervious documents with a new cover letter re-explaining the situation and again nothing, this has now happened 6 times, I have also called their office in which one of their advisors could see on the system and agreed with me if I sent another letter it should rectify the problem, again I did this and heard nothing back until I received ANOTHER letter, I called again and spoke to an advisor who told me that if the penalty was issued before the acknowledgement (which I have no received) twice I might add, then I would have to pay.
I fail to see how they can render all acknowledgements useless, surely if I send a letter explaining the situation and querying the penalty, and as it seems to me THEY have LOST the documentation, surely I am legally entitled to a: I personalised response from the letters I have sent in which were registered and signed for by them, and if they have lost the documents or they have been lost in a postal strike there must be some kind of come back, I have done my end of what I was supposed to do, it sickens me that I have to pay hand over fist money that I really don’t have to loose for something that really isn’t my fault, if their department is obviously quite incompetent to say the least, I really wish I had the right to bill them for all my wasted time in letter writing and postage blah blah blah I’d certainly tap them for more than £80.

I guess my main question is would it be worth contesting further, the lady on the phone said I could write and contest but my question was, simply I haven’t had any response so far other than more demands, why would they suddenly respond to a contest???

Any help in this matter would be more than appreciated

  • Never, never,never, EVER give in to bullying of this sort. If you can prove you did what you should have done then fight it down to the last.
    They BANK (literally) on people backing off from bureaucracy.
    Keep going and keep posting here if you need encouragement/support.

  • Thats the attitude that my head tells me to do, it would be so easy to just pay it so they can have MORE money out of me, I can imagine there are thousands of people who give in, if anyone can find any liks or info on articles that relate to them loosing info and stuff around the last quarter of the year that would be most valuable.
