    I think all those who have jumped down this posters throat owe her an apology!!!
    She enquired about possibly getting recompence from Jongleurs...who by all accounts were not affected directly by the fire... they may of lost a bit of business that night, but not the building! They were only affected due to having to be evacuated!

    I can understand the poster is only enquiring as to whether she may be able to get something back from an unfortunate event, she is not trying to MAKE anything from her enquiry!

    The rudeness shown here in this thread is totally uncalled for... as the saying goes if you don't have nothing nice to say, then its best to say nothing at all.

    No wonder some people get wary of posting on this forum!!!

    To the OP...I hope you get sorted out one way or the other regarding this...I think it is worth you ringing Jongleurs to see if they may be rescheduling the night.

    You didn't come across as heartless at all. Try not to worry about upseting gimps on here, many like to roast (no pun intended given the subject!) without engaging brain first!

    I'm not sure what ejones999 means by saying: "It's a pity that it took 4 posters to berate you ( and nobody agreeing with you) before you came to this conclusion."

    What conclusion? My stance on this has always been the same-I posted to see if anybody had been in a similar situation and whether we may be able to go back to Jongleurs another time, or get a refund on the tickets. In all of my posts I have sympathised with the people who have suffered from the aftermath of the fire, and thought I had made it clear that I cared about peoples safety. Being caught up in the fire ourselves we saw first hand the devastation and immediate after effects.

    I was just genuinely interested as to whether a large company such as Jongleurs would be able to do something for the 400 people who were booked for the show on Saturday night, or whether it would be put down to force majeure. From a personal point of view, I am unlikely to be in a financial position to be able to do something like that again for my husband for a very long time, which again was why I originally posted.

    If I had come on here and asked how I could profit from the fire, or if people had been physically injured or worse in the fire and all I was worried about was the financial aspect of it, I would expect the replies I received.

    I'm sorry if this post goes on, but I feel like I'm having to defend myself to everyone reading this. I feel like I've been made out to be this monster who only cares about money which is not the case at all. Everyone is entitled to their own thoughts and opinions, and I understand that not everyone will agree with me, but the sarcastic and rude replies were quite hurtful.

  • as you can see from the previous posts and some of the comments made by certain people are hurtful and sarcastic.these people dont no who you are and all the effort into trying to make it a great day out for your husband,family and friends.these people who post nasty and hurtful comments like that have nothing else better going on in there lives and sit and wait for peple to post things just to pick fault with some one.if it wasnt you it would be some one else so just let it go in one ear and out the other.when these posters get loads of stars besides their names it all goes to their head and it gives them a sense of being some one when they have 3 or 4 stars beside their name(like they are a hollywood star)NOT!
    ignore the comments,some of them have nothing else better to do.WOW look at me i got 4 stars and can pick fault with everbody else!!GET A LIFE!!!!

    It means the contract by Jongleurs was no longer capable of performance. i.e "frustrated contract"

    Hackney Borough Council v. Dore (1922) 1 KB 431 it was held that "The expression means some physical or material restraint and does not include a reasonable fear or apprehension of such a restraint".

    No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity [or telephone service], and no other Party will have a right to terminate this Agreement under Clause 19 (Termination) in such circumstances."

    "Any Party asserting Force Majeure as an excuse shall have the burden of proving that reasonable steps were taken (under the circumstances) to minimize delay or damages caused by forseeable events, that all non-excused obligations were substantially fulfilled, and that the other Party was timely notified of the likelihood or actual occurrence which would justify such an assertion, so that other prudent precautions could be contemplated."
    You will have a claim against Jongleurs insurance.

    You can tell that its half term - the uneducated kids are on the computers with their terrible grammar and spelling.

    From a business sense, Jongleurs might be very happy to accommodate you in future. They are a large organisation who like to keep people happy. It's not heartless or tasteless to speak to them and say you'd all like to go and finish off your evening at some point!
