What a bunch of w***ers!!

GRRRRRRRRR!!!! :mad:

My husband recieved a letter this morning from a debt collector, asking him to call the number straight away to pay the £4,990 he owed. Well, we were a bit baffled to be honest as there was no explanation as to what the debt was for, so he called the number to be told he owed Yes Car Credit the amount for a car he never paid for in 2004. The car was given back to Yes a few weeks after he bought it - he did take out finance and paid a £1000 deposit. The car was going to be auctioned and we'd hear more about it in due course was what they said. Then I think Yes went under.....

...anyway, four years later, this random 5grand pops up from nowhere! Hubby is not paying it as he's not convinced he owes this. Where's the proof? :confused: The girl on the phone was dead rude to him - wanted payment but wouldnt confirm what the debt was made up of. Told hubby it was against the law for her to tell him what the money is for roflmao!! Hubby then told her he would be writing a letter and no further correspondance would take place via phone :cool: . He never once admitted to the debt being his. As far as we're concerned it isn't. :confused:

Is now the right time to request the CCA? This is a mssive bolt from the blue and we are not prepared to pay £5k for a car we had for 4 weeks from a company that no longer exists and without any info of how much the car was sold for at auction, or without a breakdown of the costs.

Added to that I got a letter saying I would be getting a visit from a debt collector for a bill from talktalk I apparently owe. Bring them on I say!! :rotfl:

    Ask for a CCA, and don't admit to the debt. If they keep harrassing you, change your phone number, its free to do so.

    Definitely ask for a CCA. Somone might know more about this but wasn't there a problem (for Yes Car) with their agreements being written incorrectly and therefore unenforceable?

    Oooh, thats interesting fb...I will do a search on the forum and see what comes up re Yes.

    The whole thing seems so dodgy to me. The fact she said she wouldnt tell my hubby what the debt was for set alarm bells off. Oh, and she didnt even know our address! She asked dh if he lived at blah blah, and hubby said ermm, no! Weird!!

    not really an areas of expertise for me but seems like the Debt collectors are simply fishing for a bite....give them nothing..but from what you say about TalkTalk I'd suggest having a check on your credit files to see if there's anything dodgy going on....sounds very iffy...how long have you lived at your place?

    5k seems to be their favourite figure, well Thames Credit anyway.

    My OH had a car from YCC, who forced him to take their insurances out etc.

    The car he bought with them was say 4k at the time, he traded his car in which he had 1k for.

    He began making payments but 6 weeks after he had the car it was stolen.

    His insurance paid out for the car so you would have expected the debt to be cleared at this point.

    Nope not with YCC! They still wanted the money he would have paid for the insurances for the full term of the loan as you had to pay them for 3 months before they came into force, as it were, the insurance for the loan wasn't going to pay out because his car was taken at 6 weeks.

    They're a dodgy bunch.

    He gets an occasional phone call at work and a letter once a year, I think their last offer was for £500 to settle the account. He has told them on many occasions to take him to court but they seem reluctant to do this for some strange reason lol.

    Another thing that I've just remembered - the woman from the debt collector asked dh where he worked and whether he was full time - dh refused to answer this and she said "well, that doesn't matter - I'll find out anyway.." Shocking!

    I'm still so angry about it all. Trying to find a template cca request letter. Do you think I should include anything else in the letter?

    It's easy to give in to that negative voice that chants "cant do it" BUT we lift each other up.
    We dont count all the runners ahead of us & feel intimidated.
    Instead we look back proudly at our journey, our personal struggle & determination & remember that there are those that never even attempt to reach the starting line.

    This has now been saved in my 'List of Things to Say when DCAs call'!!!!
    Almost debt-free, but certainly even with the Banks!
