Hi
My sister has an A&L Credit card she only uses for mortgage payments.
She noticed she didnt have enough for the payments this month and took more interest in the statement.
The card had been Used in Carphone Warehouse for £250
It had also been used multiple times at Tesco (online)
She called A&L as soon as she was aware who have began an investigation.
Interestingly they have NOT suspended the card but want to allow it to run (perhaps to aid the investigation)
Looking at the history of the cards use, this fraud has been going on for Months and involves over £800.
A&L have told her they will only refund the fraudulent use during the last 60 days!!!
I know she should have kept a better eye on the statements but she said because it was only used for mortgage payments she never took any notice.
Is this 60 day limit normal???? Surely all fraudulent transactions should be covered???

Following are A&L Credit Card Terms & Conditions.
5b If your card or cheque is lost or stolen or someone else finds out your PIN, or if you think your card, card number, cheque or PIN may be misused, you must:
· call us immediately on one of the customer satisfaction numbers shown above section 4 (we have a 24-hour service) so that we can stop the card, card number, cheques and PIN;
· if we ask, write to us within seven days to confirm the loss, theft or possible misuse (the address is MBNA Europe Bank Limited, PO Box 1004, Chester Business Park, Wrexham Road, Chester CH4 9WW); and
· stop using your PIN, card, card number and cheques immediately.
5c If you find your card after you have reported it lost, stolen or misused, you must cut it up and tell us as soon as you can.
5d You will not be liable for any use of the card, card number, cheque or PIN by another person who does not have your permission to use it unless:
· you, or your additional cardholder, agreed to that person having your card; or
· you, or your additional cardholder, have acted dishonestly or very negligently.
5e You must make sure that you, or your additional cardholder, report the matter to the police and, if we ask, you and your additional cardholder must give us all the information we need to help us investigate and recover our property.
5f We may tell law enforcement agencies any information which we reasonably believe may be relevant.
Your sister should write immediately (dont wait the 7 days) disputing all the fraudulent transactions).
Good luck.
Just picked this up from The Telegraph

Thanks James
I think she has written (I believe A&L sent her a form to fill in listing all disputed transactions)
Thanks for the link. There does seem to be some substance to the time limit. unfortunately it doesn't mention what it is.0 -
Sorry there has to be a time limit.
Your sister has been incompetent in the extreme not checking her statement!0 -
Thanks for that Pearl of Wisdom, Man U freak!0

Completely pointless reply to a genuine question.
Why don't we all go into the DFW forum and slate all the idiots on there for falling into huge debts???
Hindsight is a wonderful thing!
I don't see why there HAS to be a time limit to reclain fraudulent transactions. How long do crimes last in Law?
If the person who commited these crimes eventually gets caught.... are they going to ignore all the fraudulent purchases which occured over 60 days ago???
They MUST do surely!! The credit card company have no right to the money back because the legitimate card holder has already paid them.
I would hope no-one (not even you) would agree the thief should keep the money/goods obtained because it was over 60 days ago.
You are saying that any crimes commited over 60 days should not be investigated. After 60 days the case should be closed.....
I say again.... your little Pearl of Wisdom telling someone they should have checked statements more closely was a pointless trolling dig.
You appear to be sitting on a completely inappropriate high horse (I am right!! lol) as if you are offering some new information..... "hey chaps, do what I do and check statements, I am always right" jackass!0 -
If somebody chucks a brick through your window and you do not report it for more than 60 days do you think the police would investigate or tell you where to go?
Do you think the police would investigate a break in if you left it over 60 days - of course not.
Get Real!
I may be a jackass and may ride on a great high horse but I do check my accounts on a weekly basis online.
It is not a dig and I am not a troll but it is true.
Sorry your sister seems to have lost out but perhaps this will teach her a lesson.0 -
I suspect that one reason for the time limt would also be that the trail will have gone cold, how far outside the time limit were the first fraudulent transactions? It is harsh to say, but even if she had just glanced at the statements the problem would have been apparent,so did she just throw them unopened into a drawer?. I also find it strange that they have not cancelled the card.....never heard of that happening before, this has happened to us twice and both times the cards were stopped immediately.(unless it is because of the time involved in notifying and they are trying to keep the trail alive?).
I hope things work out, but I suspect that your sister has learned the hard way that banks have their rules, and if you do not stick to them you will be the loser.0 -

It does sound like she never even looked at them, only she knows the answer to that.
It sounds strange to me too that they haven't cancelled the card. My card was compromised a while ago and it was immediately cancelled.
I suspect by leaving it open, they will have a chance to close in when it is used again.0
