Can anything be done about cowboy developers?

I recently bought a flat off plan. My circumstances at work changed so as soon as it was ready I put it up for sale. So far no joy. The quality of the flat is very poor, the block is also is a very messy state. There is no sign of the 'management company', grass is overgrown etc. Speaking to other flat owners they are also very unhappy, some are talking to solicitors.

I have written to the developer and so far they are not responding. what comeback do we have or does everything side with the developer these days? Can we take them to court to order them to spend money on doing up each flat to the standard we agreed to buy?

    The leaseholders can join together and take the 'right to manage' away from the developer and their agent. You can then choose whether to run things yourselves or employ your own agent :)

    As for workmanship, I can't recommend anything if it's already at the point where some leaseholders are talking to solicitors. They really can't have got much joy!

    If you are trying to sell, then I'd get it sorted yourself and hope for the best price. :confused:

    Yes it is, ideally I need to sell ASAP but can't sell with the state it is in.

    How would we go about taking away the 'right to manage' - are we basically forming our own management committee? The developer built the property as his own company, then formed a new company run by him to be the management company.

    It looks really complicated but we used a company called Canonbury Management who did all the paperwork for £100 per flat. They set up the company for you and serve the notices to the existing managing agent and the freeholder.

    You wait a few months and then they will offer you their services as your new managing agent, or you can decide to use someone else, or just do it yourself.

    LOL! I haven't seen that! I'll read it now. We didn't get the house. There was a guy sitting right at the front and he just kept on putting his hand up, he wasn't even wavering.

    Did you see the 3 bed ex-LA house in London that SOLD for £121,000. We were moaning saying how tedious it was that they were even bothering to let the people bid that low when it evidently wouldn't sell, then had a chat about perhaps approaching the agents, then BANG. We jumped a foot! Someone got a massive bargain there.

    EDIT: Just noticing that some of those properties didn't actually sell at those prices :o They didn't hit reserves. There was a flat in Maida Vale with only a 6 year lease that sold for silly money :confused:

    How exciting! Monday is going to see me watching the Savills auction! Lot 43 I viewed before the auction on Thursday. TINY flat, shortening lease.
