Hi - what kind of industry do you work in fluppy? To have that written into your contract when you are in admin? Do you do financial or legal work?

Hi,
Unfortunately it is written into our tenancy agreement that if made bankrupt we would have to move out, and it is also written into my employment contract - I only work as an office administrator.
I feel like I am stuck between a rock and a hard place.
CCCS also told me to move house to one without it written into the contract and to move jobs!

How long have you been renting your house? Are you good tenants, as in always pay on time, don't cause any problems? If so, then it's highly unlikely you would be evicted
To your average LL having a regular paying, trouble-free tenant is more important that you being BR. Do you rent through an agency? If so, you'll often find that clause is standard but very rarely actually acted upon.

It's to your credit that you want to pay these loans off....but 86k is a mortgage size debt, that many people buying a home would look to spread over 25 years. And that's at a mortgage rate of interest, not the higher rate that would apply to unsecured loans.
Are you sure bankruptcy is not an option? Seems like Hobson's choice.0 -
I would contact CCCS and make an official complaint about the person you spoke to. I'm sure they must record their calls - most companies do nowadays.0

That's a good point Keren29. The OR is supposed to inform your landlord of your BR but lots of people have successfully managed to convince them not to - you've usually got more of a chance with this as long as your rent is up to date

Sorry to hear about how you feel about the outcome of your appointment. You could come back have a second appointment with another counsellor and talk through your concerns and look at other options that are available.
Sometimes best advice is not always the easiest advice to take and big decisions take a lot of thinking about. If Bankruptcy has been discussed and was one of the outcomes CCCS have a specialist Bankruptcy support department that you could call to discuss bankruptcy questions. With regards the advice about your house and job, I think what the counsellor would of meant here is, before you choose bankruptcy as an option double check your housing agreement and employment contract as some places add a clause in contract but not all places

If, for example, Fluppy is renting a 6 bed detached with swimming pool, sauna and room for a pony, she could be forced to rent somewhere cheaper to free up more of her income. If, on the other hand, the house was suitable for her needs, then the OR would have no problem with this

We have been renting for 3 years, never missed a payment and always on time. It is through an agency .Hi - what kind of industry do you work in fluppy? To have that written into your contract when you are in admin? Do you do financial or legal work?
I work in the pharmaceutical industry.
I have decided to book a second appointment with CCCS.

I finally plucked up the courage to seek help and I called the CCCS. Well I came off the phone in tears. They just lectured me!! and then told me to go bankrupt. This is not an option I can really follow as i would lose my home and job. I felt CCCS were only interested if they could set up a DMP - as this was not available to me they did not want to know!
I have unsecured loans/credit cards/catalogues to the value of £70,000 and HP of £16,000.
I bring home approx £850 and child benefit £165.

Perhaps you would be wise to do a joint SOA so that you know what the total cashflow for the FAMILY is. It may be that you can free up some extra money to fund a DMP if you look at the joint financial picture.
Is there anything that you can sell you free up some money? Can you get a second job to raise some more money for a DMP?
I would suggest that you phone each of your creditors, and ask for the APR for the debt, because you are thinking of balance transferring it to somewhere else (little white lie I know). You may find they drop the APR to keep you. Worth a go! Just don't mention the DMP to them yet.
