Assured Shorthold Tenancy - notice period?

AST agreement from 7/6/03 to 6/6/04, became (monthly) periodic tenancy, I think. We want to give notice and was advised verbally ages ago 1 month's notice required. Now agent stating 1 months notice really means nearly 8 weeks taking us to 6/9/05. :eek:

However, after a bit of internet research, I think that as our first months rent was pro-rata to bring us in line with agents preferred payment date of 1st of month, notice should end 31/8/05.

Am I right? Why is notice period set as a trap to catch niave tenants (when is a month not a month?)? I know it seems pedantic for 6 days rents but every little bit of money saving helps, right? Plus, "$%£*^&*" agent and snotty secretary have really P^&$%d me off :mad:

Any advice to a newbie money saver greatly appreciated.

    You can check this on the website shelter.org.uk and also with CAB. As far as I remember it is one month's notice, in writing, to end on the last day of the period of your rental agreement. So you need to check that the dates on your tenancy are correct. If they are, the one months notice needs to end on the 6th of the month ie 6/8/05. Unfortunately as we have already passed the 7/7 you can't give the full months correct notice so this will now have to run 7/8/05 to 6/9/05 so the agent is indirectly correct. HTH
