    The only thing with the batons is that they arent actually blocking off the hole between the pavings and the plinth. There are gaps underneath them, and they are not all the way long (if that makes sense?) which is why i am not convinced its down to me doing that (as the council are suggesting).

    I am going to speak to my neighbours downstairs tonight just to see if i can take some pics of the underneath of my balcony (its in their back garden!) and if i can take some pictures of the damage caused to their property, for my own records more than anything.

    If it is the balcony that has the problem (i.e. a crack etc.) then it will be down to the council to pay, however if the leak has occured as a result of something I have done, then its down to me.

    Take a photo of the gaps under the batons and everything else about it. It wouldn't be surprising if they are removed and the Council turns around and says they were 20 foot tall and the spawn of Satan.

    Suggest to your neighbours that you want the photo's to back up a claim for your insurance company....and check with your contents insurer's whether you would be covered for the neighbourhood's redecorating - I know that I have been able to claim on someone elses's when the fault was theirs (and even claimed for a window that my son broke in someone else's house!)

    As a relatively new member I just wanted to say how uplifting it was to see the support you guys are giving Amy. It really brought home how useful a site this is, not just in terms of financial advice, but also from the human perspective, because it really does help to know that you are not alone.     Well the latest is that the council are sending a contractor to take pictures of my balcony tomorrow afternoon.

    I am going to be taking my own pictures tonight!!

    The guy from the council said the batons had been screwed into the concrete, which they havent. And even if they have i cant see how that would cause a leak into a downstairs property without the balcony being faulty.

    He was reluctant to say how the batons would of cause any leaking problems, so we shall just have to wait and see.

    I have spoken to 2 surveyors and each have said they cant see how this has caused a leak without there being a problem with the structure of the balcony.

    Fingers crossed it goes my way.

    Funnily enough I wrote down some pointers just after I had spoken to him, and have attached it to the letter they sent me...:beer:

    One of the surveyors from my old company is going to look at some pictures I will take and let me know if he thinks it is my fault.

    Do you have (presumaby 3rd party liability) insurance that would cover you for the damged caused, if they prove you caused the damage?
