    I take it SOA is the same as an i&e?? If it is, or similar at least, then i agree that you need to be proving to them that you can only afford what you are offering. I wouldn't necessarily advise going to the CAB. You could perhaps get some paperwork from them as to how to put this information on paper, but I've never found them particularly helpful (although their very polite and try to help), and i've always found their information slightly out dated. There's absolutely nothing that you can't do yourself with a little help from people here. Its obviously up to you, some people prefer giving the likes of the CAB or the CCCS the job of talking to these people, it takes away the stress. Personally though, I've been able to handle stuff myself with great advice from people here and feel better knowing that I am completely aware of everything going on with my finances. Obviously you have to make that decision, some may prefer to get more help. At leas the CAB, CCCS and Petplan are free. Please DO NOT go to these firms that offer tha same thing for a charge.

  • thanks elsie and ts. I would like to sort it out myself. I have checked my bank and they have cashed my cheque £20. I don't know what they're playing at, they said it wasn't acceptable and they would issue a statutory demand then they cash the cheque. Does this mean they're not going to issue one? Also I'm drafting a letter to them. If i send a request for a CCA and i've admitted i owe the debt and started to pay would this automatically mean they can't issue one. Would appreciate help....again.

    Just stick to your guns and try to set up a monthly payment. At least if, for some reason, it goes to Court (worst case scenario), then it will show a judge that you've made every possible effort to attempt a payment method.

  • i thought i was the only one not asleep, i'm normally in a deep sleep by 11, but after the phone call today, cant sleep. do i continue to send them cheques how would i prove i have sent them on time to a court if they don't cash them.

    Send them buy recorded delivery and keep the slips, that way you have indisputable proof they recieved them.

    With regard to the nusiance phone calls you should quote the Administration of Justice Act and state that this forbids Undue pressure from creditors. Under this act you can insist they contact you by letter only.

    Hi there. Does anyone know of a company called Legal and Receivables?I have had a debt for several years now that originally was First Direct. It had been with a collection agency for at least three years who had been accepting £10 per month without any missed payments. I got a letter about 6 months ago advising that First Direct had taken the debt from the existing debt collectors and had now sold the debt to Legal and Receivables and they would contact me to make payments. When i tried to call L&G on numerous occasions, they told me someone would contact me to go through my details. I heard nothing since until today when i had a call from them. The guy i spoke to told me that they had never received my I&E i had sent and wouldnt be accepting the £10 i had been making. I asked what their next step would be and he told me they would be looking at any order for bankruptcy. I had a similar problem last year with LINK financial who thanks to the help and support from people on this site, eventually backed down and accepted a monthly amount. They were threatening CCJ's and charging orders on my house. Has anyone come across these guys and if so, what are they like? I'm planning to dig out the letter i sent to LINK that got them to back down and see if i can do the same thing with them. Thanks guys

    So i got the reply today from Legal and Receivables. This is their letter:

    Thanks for your correspondence blah blah blah....

    Based on the financial details supplied your offer of £8.76 (i actually offered £10) is unaceptable.

    We are prepared to accept monthly payments of £217.98 subject to regular review at our discretion, against the full amount owed commencing 25th February 2008.

    The above arrangement is without prejudice to our right to reclaim the full contractual monies andshould payment not be forthcoming within the specified timescale.

  • Hi Guys. I need your collective help please, i'm really starting to get out of my depth now.
    I had a call from L&G yesterday telling me an order has been sent out to me giving me 21 days to pay the balance of my debt or they will be applying for bankruptcy. I've spoken to CCCS, CAB, UK insolvency service, i have an appointment with a solicitor today and am having a bankruptcy type person call me from the CCCS today also. I don't know if there is something i should be doing but i'm really panicking about the impact this will have on my mother as she joint owns my home.
    The man from L&G was rattling off all sorts of dates and figures about when i bought my home 10 years ago and thinks there is far more equity in it than there actually is, but wouldn't believe me when i told him so.
    HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    So i had an interesting discussion with the guy from legal and receivable who finally got round to asking me how much i had outstanding on my mortgage rather than telling me how much i owed. He was under the impression that i had 70k of equity in the house and that i still owed the same amount as i did when i first bought the house. I told him if i had 70k of equity, i probably wouldn't be speaking to people like him. They had now finally decided not to continue with the bankruptcy, but still haven't accepted my offers of payments so still unsure what will happen.
