10 year tenancy, evicted but what do I do?!

    Me too, shared until I was 16. The ironic thing was, ten years later I had bought a three bedroom house with just me living there! :rotfl:

    Maybe the disabled child needs his own room?

    Perhaps the other two are of an age where they can't share.

    Councils DO NOT give you more bedrooms than you need, so there must be some issues if the council have agreed to a 4 bed.

    I understood that the OP sometimes has a carer staying overnight. Diabilities often also mean lots of equipment. I would imagine the council was pretty reluctant to say that 4 beds were needed, so there will be an excellent reason.

    Equally, if it's not gonna happen, as heavily hinted already, then why add to your stress levels - a large bedroom in a 3 bed can easily be partitioned... :rolleyes::rolleyes::rolleyes:

    Of course, which is why I suggested she ask the council about the posibility of adding an extra bedroom to a three bed.

    If the council agrees she needs a four bed, then she MUST REALLY NEED A 4 BED!
  • Thank you MrsE and Kunekune.....yes it IS the case I need 4 rooms! My sons condition is such that he cannot be left unsupervised with his siblings because of aggressive and dangerous behaviour. And yes, the other 2 children are boy and girl. And as originally stated, overnite care is also an issue.

    Thank you so much for your helpful comments Daveboy. Yes I had 3 children, but I did not make the choice to have the health problems I do. And I certainly did not choose for my husband to walk out because he couldn't cope with caring for his son.

    Hollydays, they have actually given me one month longer notice than they needed to.

    I emailed my MP over the weekend, and was amazed to get a call from his office first thing this morning. They are looking into it and will get back to me ASAP.

    Any other suggestions (not you Daveboy!) are welcome. Head such a mess struggling to think straight.

    call your local council housing department - they have lists of accredited landlords - some of whom may have empty property. Councils also run a bond scheme which guarantees the deposit for a private landlord.

    does your disability have a name - and if it does - there may well be a pressure group ? is there someone on this pressure group's Board who may be able to offer specific ways for you to be given priority, and speed, on the local housing association waiting list ?
  • Maybe a three-bed house with two downstairs rooms would do, or one big room that could be partitioned.

    Do the Council class these type of houses as four-bed, or would it be worth your while suggesting this to them?

    Hi, I wanted to post as we are kind of in a situation like yours. Last November we was told to leave our long term let as it was being sold, the council told us they could do nothing without is being evicted. This means the Landlord had to serve us with a section 21 notice of 2 months and, when the date arrives (it has) we have not left. The landlord then has to take us to court ot get the house back, once we have a date/have been to court and have an actual eviction date we can then be classed as homeless. before this it works on the points system, although you and your son are disabled only one of you wil get the points - that will cover both of you as the person in most need is given the most points - but even in our case we have been awarded one of the highest amount sof points and still do not have enough points to get housed. As has been explained to me though, once we become threatened with homelessness (that is, when the court have given us 28 days to leave) then the points become irrelivant.

    If you have 28 days left before you have to leave you can then approach the homeless department and appeal to them, if you leave before the court has told you to then you are making yourself homeless and so they don;t have to house you. Homeless accomodation is just temporary accomodation and you will stay there until something comes up that is suitable for your needs.

    I can totally sympathise because my son has always ben difficult and has his own 1:1 teaching assisstance and is on an IEP, he has recently been diagnosed with ADHD/Oppositional Dispute Disorder and being on the autistic spectrum (we have now to start going to CAMHS, Physciatrist's etc... to find out 'what kind' of autism he has), we cannot leave my son in the same bedroom as his sister for the same reasons you have with you son and have asked he can have his own room. The council still not tell us whether we can have a 2 or 3 bedroom house as we only 'need' 2 unless they tell us otherwise (if that makes sense) - and this will mean if they consider we only need 2 and we need HB they will only give us HB for a 2 bedroom house. Homeless accomodation (we have been told) usually means a hostel - and apparently despite his condition it will make no difference, if you are desperate enough to be homeless you will take it, if you refuse then they have no obligation to house you and longer. I have a long thread running on this at the moment with updates if you click on my user name and 'more posts' you will find it.

    The problem is housing benefit and many of the EA say 'No Housing Benefit', like you we had problems because we are rural too and not much about. So now we are just waiting for our court date so we know where we are and can tell the council that we are going to court on xx date or are being evicted on xx date. If you leave on your own accord then you need to be careful of this - it is rubbish but you really need to check this out as the council do not have any obligation to house you if you have not actually been told by the court to leave. Please do check this out with the council/CAB as they were quite blase with me initially and they have even told me stuff that would mean I would be making myselfl intentionally homeless, they can be very decietful beleive it or not, so please check it out thoroughly and make sure you are not getting yourself into a hole where they can wash their hands of you. The house we are living in is on the market and is on the internet and the EA website and shop windows, but the council won't consider us until we have that date from the court.

    Hope that helps explain things a bit more. I would second what the others are saying though, maybe they can give you a 3 bedroom place that has another large room so it can be turned into a bedroom. Rather this than nothing at all - if there is nothing available then they cannot give it to you. Good luck, keep us posted on how it is going.
  • Thanks for that suggestion Clutton, have already made sure I've registered with all the accredited landlords and private housing associations, but no luck so far. We do have a bond scheme here, thought they only cover upto £350. And to be honest deposit not so much of a problem as family willing to help there, it's the monthly cost on a long-term basis that's more of a problem. Health issues are neurological whoch means intractable chronic pain, and continence issues. Have contacted relevant associations I can think of but no joy as yet.

    I suggested the large 3 bed option to the council, though apparently nothing big enough in area we need to be in to ensure son can attend school and care needs can be satisfied.

    Blue_monkey, our priority is based on a banding system, not points like yours. And apart from those who are at threat of death, or homeless due to fire or flood, we're top of the list. As for your son, sounds like he could be my son's twin!!

    Thanks for everyone's help, I really do appreciate it. Have to call housing benefit manager tomorrow, apparently he's coming out to see me. Fingers crossed I may get somewhere with that :confused:
