urgent advice needed on bad tenants

    just visited the moneyclaim website. does anyone know there charges as am thinking of using them but would like to know what am signing up to

    You need to give a minimum of two months notice and that must end after the end of the fixed term. If you serve it by post you have to allow a few extra days but if you serve it by hand then it is deemed served the day after I believe. So if you served it personally tomorrow 4th Feb then two months would take you to 4th April and it is past the end of the fixed term which I assume ends on 31st March 08. I would then ask for possession after 5th April to be on the safe side. I think that's right. Change the dates accordingly depending on when you serve it. I am sure someone will correct me if I am wrong!

  • Convince yourself your not cut out to be a landlord.

    Issue the correct notices, evict them, sell the property and go do something entirely different.

    as i said - join National landlords association and their free legal helpline will talk you thru every question on the court forms. Court summons will cost you £150 and if you get one date wrong the judge will throw it out and you lose £150 and have to start all over again. NLA is well worth the join.

    Use section 21(1)(b) if the 2 months notice starts in the fixed term and ends no earlier than the last day of the tenancy but if the end of the 2 months notice falls outside the fixed term it doesnt matter what day it ends on.

    Just make sure you give 2 months and 2 working days (for service) notice and send 1 by post with proof of postage and 1 by hand with witness or by normall post.

    Dont give any reasons or conditions. A section 21 is supposed to be unconditional and can muddy the waters.

    :T:Tthanks every one for your advise. i sent off the notices today and i will keep you all updated. i hope they leave quietely so i dont have to go all the way to the courts.

    silvercar was wright about these people(tenants) being proffestionals. i dont think this is the first time they have done this. realised this when doing the dates and arrears

    You shouldnt have not taken a deposit, like whats been said this pair are a couple of pro's!

    Lesson one: If someone seems nice they are pretending and if someone says something assume the complete opporsite. People !!!!!!!! all the time so you have to learn to sniff it out!
